EDGE STEPHENS’ DECISION
OF INTERSTATE
COMMERCE COMMISSION!
Said Evidence Shuwn was Most
“Startling.”
Chattanooga, Tenn , Dec 15.
Judge Severens, of Kalamazoo,
Mich., sitting in the United States
court here to try causes in which
judge C. D. Clark is disqualified,
today rendered a decision in the
case of the interstate commerce
commission against the old East
Tennessee Virginia and Georgia I
Railroad company and other rail
road companies entering Chatta
nooga .
The case grew out of a complaint
made by the chamber of commerce
of this city to the interstate com
merc » commission in 1892, that
the said raihoads were discrimina
ting against this city in the matter
of freight rates in favor of Nash
ville and Memphis, both of which
cities were in competition with the
business of Chattanooga.
The point ra’sed was that the
railroads were not justified in
placing NashviPe on the water
rate as against Cnattanooga. It
was charged and shown by the
tai iff rates of the defendant com
panirsthat goods were shipped
from the East to Nashville and
back to within a veiy short dis
tance of this city at a lower rate
than was given fiom the East to
Chat'anooga. The question of
t e application of the “long and
short haal” mauses to the case at
nsue was also raised and decided.
The interstate commerce commis
sion had decided that the roads
were discrimiuatingand that Chat
tano’ ga should be put on the same
basis with Nashville, and that
Chattanooga should be given the
same rates.
In his decision Judge Severens
said:

wrong and badly in need of cor
rection.
“I shall not deny that the car
riers had a right to take iiits con
aidera'ion the fact, as adduced
here, of a low rail and water rate
from the East via Evansville tol
Nashville in making and forming
their rates, but this rule is not to
be carried to unreasouab’e lengths
in making defense in this instance
and unless the carriers can show
| where the commission failed to
take into account some material
right winch the car had. I will
sustain the order of the corn mis
sion. However, Ido not belt ve
counsel for the carriers can prove
this point. The bu'deu of the
proof is upon the carriers, and 1
shall give their attorneys ten days
in which to file a brief showing if
such can be done, that the com
mission erred in refusing to allow

days in which to answer the brief
of the railroad’s attorneys. As I
said before, the evidences of dis
crimination against Chattanooga
are startling and I do not see how
tno commission could have done
otherwise than they did. Unless
the counsel for the carriers shall
find m >re proof than is in the
record now I siiaj| sustain the
commission.”

counsel for the intersta'e com
merce commission, states that
this is the strongest case the com
mission has ever had against
railroads showing unlawful dis
crimination.
