An Ordinance
Authorizing the Southern DBell
Telephone and Telegraph Company
to use the public roads, streets and
. highways of the city of Hazlehurst
Georgia, for the purpose of placing
poles and electrical conductors
thereon, and to acquire, operate
and maintain the lincs of telephone
and other telephone property of the
Hinson Brothers, now located in
the streets and public places of the
city of Hazlehurst, Georgia and to
authorize the Hinson Brothers to
sell all of ther telephone lines,
poles and wires, and other tele
phone property, in the streets and
publie places of the city of Hazle
hurst, Ga, to the Soutnthern Bell
Telephone Company.
Section 1. Be it ordained by the
General Council of the city of Ha
zlehurst Georgia, that permission be
and the same is hereby granted to
the Southern Bell Telephone and
Telegraph Company, its successors
and assigns, to erect, operate and
maintain lines of telephone and tel-
egraph, including the necessary
poles, fixtures and electrical con
ductors upon, along and over the
public roads, streets and highways
of the city of Hazlehurst, Ga, as its
business may from time to time re
quire, provided that all poles shall
be neat and symmetrical.
Section 2. That the work of eree
tiug voles by virtue of this ordiance
shall be doze under the suporvision
of the street commitice, and the
gaid Southern Bell Telephone and
Telegraph Company shall replace
and properly relay any cidewnlk or
street that may beo displaced by

and upon failure of the company so
to do, after twenty days, notice in
writting shail have been given by
Mayor of the city of Hazlelinrst Ga,

Suetion 3. In consideration of
the rights and privileges herein
fimnte‘d, said company shall, upon
emand, provide one cross--arm on
each pole, on which the city of Ha
vlehurst, Georgia, may desire to at
tach either fire alarm telegraph
or police telegraph wires, for the
free use of the police and fire alarm
telegraph system of the city of Ha
zlehurst, Georgia.
Section 4. Said company shall
at all times be subject to the city
ordinances new in existence or which
may be hereafter passed relative to
the use of the public streets by tel
ephone and telegraph companies.
Section 5. Said company shall
indemnify the ecity of Hazlehurst,
Georgia, against and assume all
liabilities for damages which may
arise or accrue to the city of Hazle
hurst, Ceorgia, form any injury to
persons or property from the doing
of any work herein authorized, or
the neglect of said company or any
of its imployees to comply with
any ordinance relative to the use of
the streets of said city, and the ac
ceptance by the company of this
ordinance shall be an agreement by
it to pay to the city of Hazlehurst
Georgia, any sum of money for
which the city may become liable
from or by reason of such injnry.
Section 6. The said Southern
Bell Telephone ana Telegraph com
pany is hereby authorized to ac
quire, either by purchase or other
wise, all of the equipment, lines and
wires which now constitute the en
tire telephone plant of Hinson
Brothers, and the said Hinson
‘Brothers are hereby authorized to
sell and transfer said property to
the said Southern Bell Telephone
and Telegraph Company; and the
said Southern Bell Telephone and
is hereby authorized to maintain
and operate said lines and property
or such parts of them as it may de

of gaid citv of Hazlehurst,. Georgis
and clear of any and all conditions
or charges heretofore imposed upon
said property or said Hinson Bros,,
by any ordinance or ordinances of
agreement or agreements with the
city of Hazlehurst, Georgir.
Section 7. Said company shall
file with the Clerk of the Council of
Hazlehurst, Ga., its acceptance
of this ordinances within sixty days
from the date when it shall take ef
fect. ;
Section 8, Thisordinance shall be
in force from and after the date of
its passage.

Be it resolved by the Mayor and
Council of Hazlehurst, Ga, in coun
cil assembled.
’ 1, That the agreement dated 27
‘day of Octeber 1909, between the
‘Southern Bell Telephone and Tele
graph company and the city of Ha
zlehurst, Ga, with reference to
rates to be charged by said com
pany for local exchange telephone
services in Hazlehurst, Ga, which
agreement, has been read and con
sidered, is herehy ratified, anprov
ed and confirmed, and the Mayor
of the city of Hazlehurst, Ga, is
hereby authorized and directed to
cxecute the same in behalf of said
city and the city Clerk is hereby
authorized and directed to attest
said agreement and to aflix thereto
the official seal of the city of Hazle
hurst, Ga.
2. Taat the Railroad Commission
of tie 8 ate of Georgia is hereby re
quested to approve said agreement
this day made.
3. That the citv clerk is directed
to make a certified copy of. said
agreement and of these resolutions
and to furnish the same to said
Railrcad Commission.

2. That the city clerk is hereby
authorized and directed to make
a certified copy of this resolution
under the seal of the city of Hazle
‘hurst; Ga., and to furnish the same
to the Railroad Commission of
Georgia.

This agreement, made and enter
ed into the 27 day of October 1909
by and between the Southern Bell
Telephone and Telegraph Company
party of the first part, and the
Mayor and Council of the city of
Hazlehurst, Ga, party of the second
part; -
WITNESSETH
That, for and in consideraticn of
the said party of the second part
having granted by ordinance adop
ted on the 27 day of October 1909,
certain rights to the party of the
first part, it is hereby agreed be
tween the said parties as follows.
The said Southern Bell Telephone
and Telegraph Company, its succes
sors and assigns, will furnish local
exchange telephone service at its
Hazlehurst, Ga., exchange at rates
not to exceed the following;
1. When the number of stations
connected with said exchange shall
not exceed three hundred (300) the
rates charged shall not be in excess
of
Unlimited special line business
stations, $3.00 per month; unlimi
ted duplex line business stations,
2.50 per -month; unlimited special
exceed three hundred (300) and
not exceed five hundred (500) the
rates charged shall not be in excess
of, Unlimited special line business
stations $3.50 per month, unlimi
ted duplex line business stations
3.00 per month, unlimited special
line residence stations 2.00 per
monsh, unlimited duplex line resi
dence stations 1.50 per month.
3. When the number of stations
connected with said exchange shall
exceed five hundred (500) stations
the rates to be charged by said par
ty of the first part shall not be in
excess of those charged by said
company in Georgia towns of about
the same size and operating under
substantially similar conditions.

State of Georgia relating to the is
sue hereof has been duly complied
with and that the issue hereof has
been authorized at an election duly
called and held for that purpose by
a vote of two-thirds of the qualified
electors of the city and that this
bond is within every debt and oth
er limit prescribed by the consti
tutiou or laws of the State of Geor
gia
