The Health of Mb. Davis.— A correspond
ent of the Baltimore Gajsette, writing from
Hampton, Jan. 16, Says T
“We hear occasionally some news of Mr.
Davis, and some lately which is authentic. Hr
has twice been very sick within the past six
weeks, suffering from erysipelas, and at om
time was at tbe point of death; so near to it
that he gave to his physicians many fareweli
messages to his wife and family, and expressed
a wish that the world might know through him
(tbe physician) bow pure and disinterested bi
motives bad been in all that he had undertaken
This tame physician has been removed from his
place, and ordered elsewhere. It Is presumed
that be showed too much sympathy for his suf*-
sering patient. The guard, over Mr. Davis—
always very heavy—has beeo recently doubled,
and the officer who remains in the same room
with him is not allowed to speak, read, amok,
•r sleep during the twenty-four hours of bis
watch.
“ The name of Gen. Miles is not among the
number of general officers lately mustered out,'
and it appears that be will be retained to take
charge o. Mr. Davis, since he so literally car
ries out his instructions from the Secretary 01
War."
Important Decision.— We learn from tbe
Nashville Dispatch that the Supreme Court o'
Tennessee has lately pronounced a decision
which will touch the vitals of many transac
tions entered into during the war The case
was as follows:
It was in the case of©. B. Wright and It
Cantrell, plaintiffs in error, against Wesley
Overall. The case came up from the Circuit
Court of DeKalb county. Plain tiffs in error
had executed their note to Samson Yergan for
the sum of SBOO. The note had been assigued
by Yergan to Reuben Scott, and by Scott, to
Overall. On the 9th day of December. 1862
Wright and Cantrell had paid Overall S3OO iu
Confederate money, and bad taken his receip l
tor the same. The credit was not enterod oi
the note, though it is a matter of record, 1 e
promised to make such credit In the Circuit
Court, Overall sued for the full lace of the note,
and the court gave judgment for that amount.
Hence Wright and Cantrell came up by wiit of
error. TheSuprrroe Court i ffirtn the judg
ment below, in an opinion recorded by ihr
leading members of the bar ns an able one
The cardinal points assumed by their Honors
are; 1. That the courts cttonot recognize as a
power capable of issuing money, thst which is
not and never has been so recognized by the
Legislative and Executive branches of Die
government. 2 That the so-called Confeder
ate States are not recognized by those branches,
and never were. 3. Therefore any paper
issued by the said Confederate States purport
ing to be money, cannot be recognized as such
by tbe courts.

New Yohk, January 29.—The steamship
South American, which lelt Rio Janeiro Janu
ary 2J, 4, p in., by Bahia, Pernambuco, P.tra
and St. Thomas, ai rived this morning. Amo;g
her passengers is General Wood, agent of the
Southerners ih the Brazil emigration enterprise
The war between Brazil aud Paraguay was
still going on with vigor. The allies were, m
last accounts, Marching directly to Passa d»
Patters. General Cairo, who with his cavalry
was watching the Paraguayans, withdrew
across the liver.
'General Flores had formed a junction with
Castros’ cavalry, and was at Ibrahabry, abnui
one hundred miles southeast of Passa da Pul
lore. About 50,000 troops had arrived at Cor
n-rates for the Brazilian army, besides srnio
cavalry, and there were more on the way.
An iron-clad reached the city of Corrieutef,
and was to join the fleet with some other voa
srls in a few days. The fleet remained before
Corricntes, ss last reported. The river was
lysicg, and it was understood that when the
allied armies arrived opposite Passa da Pullor ■,
the fleet would co-operate and protect the cross
lug of troops at that ford, where, hewever, the
Paraguayans are poeted in force, and have
fortifications and a French gunboat.
The rmall-pox committed much rava
amoDg the troops and citizens of the capital.
Lopez issued a proclamation to his troops,
exhorting them to fight gallantly against the
invading armies.
It is probable, however, that the army will
.crow at Passa da Pallora will force i's way io
the rear of the Fortress and capture it from the
land side.
In Rio nothing of note occurred. The dis*
1 eteh of troops to the Platta continues unabat
eu.
The Anglosßrazil Times, speaking of South
ern emigration, says Geaeral Woods goes by
this packet to the United States, returniug from
his mission to tbia country—a mission which,
we think, will be productive of good. Geneial
Wood has received the most eordial reception
from the people of Brazil and can guarantee a
like friendly hand will be held out to those Its
represents, should they come to Brazil The
government of Brazil is prepared to furnish
litem facilities and General Wood’s views as to
the government furnishing a vessel gratuitous
ly for emigrants to every two furnished by the
latter, has met with the sanction of the Minister
of Agriculture.
New York, Jan. 29—The official prelimi
vtary report of the Revenue Commissioners is
published. The Commissioners have adopted
the plau of taking up specifically, tboae noumn
of revenue which our own experience and the
experience of other countries have indicated tis
likely to be the taort productive. The result
of these investigations they propose to eul>~
mit, in the form of independent and special
reports, to the Commissioner. They complain
of the imperfect, incorrect statistics furnish* d
them by the # government bureaus, and the
great difficulty experienced in the conduct of
their investigation, owing to the disturbed
condition of every brancli of trade and indui
try since 1861. Through the frequent altera
tions of the tariff and the inauguration of the
Internal Revenue system, many branches of
trado aud industry have been curtailed during
this period from 80 to 16 per cent.

the south side of the Public Square, last night,
in a room occupied by J Christian, as a lager

in the following terms: Representatives shall

taxable property in each State. An amends
meat of this kind would, iu his opinion, place
the basis of representation and direct taxaiion

part, men who were Bubject to draft and enlist

that the property should compensate for

suggested, would relieve from Congress all

the races it would leave the States to deter
mine absolutely the qualiticaiions of their own
voters iu regard to color, and thus the number
of ibeir own representatives to wbfob they
would be entitled in o©*«r««* -wonld depend
upon the number on which they cou‘erred the
right of suffrage. The President, in this con
nectirn, expressed the opinion that the ogita
tionof the negro franchise question in the Dis
irict oi Columbia at this time was the mere
entering wedge to the agitation of the questforr

e 1 lied tor, and calculated lo do great harm. He
believed it would engender enmity and strife
between the two races and lead to a war be

negro. Precedent, he thought, should be

country, and the prosperity of the people.

government is preparing to receive Sweeney
aud Roberts, who they have positi/e informa

All service militia are to be called out im

elsewhere. The banks have sent their specie
to fortified points forsafety.
Circulars have been -sent to tbe cadets order,
ing them to prepare for service ; still, the peo
ple know nothing of tfe danger threatened,
and are not at all excited.

Kingston, C. W„ January 28.—There are
mysterious military operations going on. Forts
aro all being strengthened and new defenses
are being laid out on Wolflslatid. The banks,
I am assured, have sent all their surplus specie
to fortified cities.
Private circulars have been sent to all cadet
graduates ordering them to hold themselves in
readiness to take commands in tbe service. The
militia are to be called out immediately-
Government evidently thinks Sweeney
means what he hints at. The people are not
much alarmed.

The Tallahassee Floridian, alluding to the
speech which Gen. F. B. Blair made before the
