1. The revocation of an order appointing
a receiver, Is a matter winch may be heard
and acted upon by the Judge, on the usual
notice in vacation.
2. The extraordinary writs and remedies
granted by the Chancellor, before a trial,
on the merits, ought not to be granted with
out caution, and unless there is immediate
danger to the rights of the complainant, if
they be denied, and if the court become
satisfied that the danger does not exist, it
is his duty, on proper notice, to discharge
them. - ■'* 5
3. In this case, the court did not err in
dissolving the injunction, and vacating the
order appointing a receiver.
4. It Is the duty of the Judge, if he is sat
isfied there is a bona fide intent to except to
Ids judgment, so to mould his order as that
the excepting party may have a reasonable
time to file bis bill of exceptions, and ob
tain a supcrcedeas before the status of the
case can be materially chinged.
Judgment reversed.

the bill, and moved to dissolve the Injunc
tion as to himself.
Held: That it was error in the court to
hear the motion, until the other defendant,
w.io was in tact the principal defendant,
had answered.

Wiien a trial Wat*bail in the Countv Court
of Sumter county, aud a verdict rendered
for the plaintiff on flie 20th day of July,
1868, and a judgment wks entered thereon
on the 22d July, 1868, and a motion having
been made in the court below to ;et aside
said verdict and judgment, on the ground
that on the days the verdict and judgment
purports to have been rendered and entered,
the County Court was abolished by tiie con
stitution of 1868, which motion was allowed
by tiie court, setting aside both the verdict
and judgment. Held, that under the recon
struction acts of Congress, the State of
Georgia hail Jully complied with the terms
thereof; ratified the fourteenth amendment
of the Constitution of Lhe United States,
and assented to the fundamental condition
imposed on her by the act of. Congress,
passed on the 25th'June, 1868; and, there
fore, the (jppstitution of the-State of Geor
gia, as amended by Congress, took effect,
and was practically in' operation from the
21st day of July, 1868. Held, also, that all
unfinished business in the County Court, at
the time of the abolishment thereof by the
constitution, was transferred to the Supe
rior Court by the 7th section of the 11th ar
ticle of the State constitution, and that it
was the duty of the Superior Court to have
ordered a judgment to have been entered on
the verdict rendered in the County Court.,
on the 20th July, unless some good aud
sufficient cause was shown, other than the
abolishment of the County Court on the 21st
day of July, 1868.'

1. Sections 548 and 550 of the Revised
Code contemplate that, in assessing the
couuty taxes, there shall be a specific as
sessment for each of the objects mentioned,
and that the fund for each shall be kept
separately by the treasurer.
, 2. Tiie act of 7th of October, 1868, direct
ing orders to be paid by the county treas
urer, according to their date, is impera
tive, but that act does not require that an
order shall be paid out of a fund not Set
apart for. the payment of debts of that
kind.
3. Where there is no direction in a coun
ty order, as the fund out of which it shall
be paid, and the treasurer answers that
there are older orders on his book of the
same kind, more than suffices to exhaust
the money in hand, not specially assessed
for special purposes, such mandamus will
not be made absolute.

1. Where there was a motion for alimony
pending a bill for divorce, and the defeud
ant in the motion moved to continne, show
ing that a material witness was absent,
without his consent, who lived in the conn
try, wd had been subpcenaed, etc. r it was
error in the court to refuse the motion, on
the ground that the granting of alimony
was wholly in the discretion of the court
and there was n» necessity for the presence
of all the witnesses.
2. The Judge of the Superior Court should
use great caution in granting alimony, so
as not to encourage applications for divorce
on light grounds.
