John Trowbridge. j { TPON the petition of John Whitehead, James 1 44 hitehead and S:>m iel Dowse, alleging that on tho thirtieth day of November eighteen hun dred and forty, John Trowbridge executed to them his certain mortgage deed whereby to indcimiifv and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on the 28 h day of August, A. 1). ei ;htecn hundred and forty-five, each for the sum of eight hundred dollars, the one payable twelve months and the other two years a*‘tcr date,signed by said petitioners as securities, he conveyed to said petitioners certain tracts or parcels ol land lying and being in said county of Richmond, the mie being in the neighborhood known as Richmond Bath, containing twelve acrestore or less, bound ed north by lands of James Whitehead, west by lands of Joshua Key*, and south and south east by the Bath tract. Also, two traces conveyed hr said John Trow bri lge by* Uaac Bryan and described as f. Hows, to I wit: “Ail those two tracts or parcels of land situ ate. lying and being in the county of Richmond and State of Georgia, one containing twelve hundred acres, more or less,on Spirit Creek, bounded north by lands of John Ctishin, deceased, east by lands of Absolom Rhodes, composed of two tracts, one rs one thousand acres, granted to di mes Beall, and another of two hundred acres granted to James McManus. Also, all that other tract or parcel of land, situ ate in same county and State, containing fourteen hundred and nearly* two a n d three quarter acres, more or less, together with 3lills and improvements thereon, and bounded east by lands, lately* own ed by the estate of Lowe, west by lands now nr lately owned by Forkerbery, south by lands b ught by one John Cashin, Senior, now deceased, oor h by lands belongingto Absolom Rhodes. And the said further alleging that the said John Trowbridge has failed and neglected to pay* said notes and has become insolvent, and that they the said petitioners have paid them and that there is now dae them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property ifiay forever be foreclosed. It is ordered that the said John Trowbridge pay* in to Court on or before the first day of the next term, the principal anil interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not he forever barred and foreclosed against him; and further, that a copy of this Rule be published in one of the Gazettes of the City of Augusta, once a month for four months <>r served on the said John Trowbridge or his special agent or attorney, and al lowing three months before the first day of the next term.
