John Trowbridge executed to them his certain mortgage deed whereby to indemnify and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on tiie 28ih day of August, A. D. eighteen hundred and forty-five, each for the sum of eight hundred dollars, the one payable twelve months and the other two years after date, signed by said petitioners as securities, be conveyed to said petitioners certain tracts or parcels of land lying and being in said county of Richmond, the one being in the neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of James AVhiteboad, west by lands of Joshua Key, and south and southeast by the Bath tract. Also, two tracts conveyed by said John Trow bridge by Isaac Bryan and described as f< Hows, to wit: u AH those two tracts or parcels of land situ ate, lying and being in the county of Richmond and State of Georgia, one containing twelve hundred acres, more or less,on Spirit Creek, bounded north by lands of John Cashin, deceased, east by lands of Absolom Rhodes, composed of two tracts, one of! one thousand acres, granted to James Beall, and another of two hundred acres granted to James McManns. Also, all that other tract or parcel of land, situ ate in same county and State, containing fourteen hundred and nearly two and three quarter acres, more or less, together with 3lills and improvements thereon, and bounded east by lands, lately own ed by the estate of Lowe, west by lands now nr lately owned by Forkerbery, south by lands bcught by one John Cashin, Senior, now deceased, oorth by lands belonging to Absolom Rhodes. And the said petitioners further alleging that the said John Trowbridge has failed aad neglected to pay said notes and has become insolvent, and that they the said petitioners have paid them and that there is now due them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property may forever be foreclosed.
