UPON the petition of John Whitehead, James
Whitehead and Samuel Dowse, alleging that
j on the day of November eighteen hun-
I dred and lofty John Trowbridge executed to them
his certain mortgage deed whereby to indemnify!
and save harmless said petitioners, conveying two
certain notes, made by said Trowbridge to Isaac
Bryan, dated on the 28th day of August, A. D.
I eighteen hundred and forty-five, each for the sum,
6f eight hundred dollars, the’one payable "twelve
months and the other two years after date, signed
by said petitioners as securities, he conveyed to
said petitioners cci'tain tracts or parcels of land
lying and.being in said county of Richmond) thei
1 one being in the neighborhood known as Richmond
Bath, containing twelve acres more or less, bound
ed north by lands of James Whitehead, west by
lands of Joshua Key, and south and south east by
I the Bath tract.
; Also, two tracts conveyed,by said John Trow- 1
bridge by Isaac Bryan and described as fi Hows, to
wit; u All those iwotracts or parcels of land situ
ate, lying and being in the county of Richmond and
State of Georgia, one containing twelve hundred
acres, more or less, on Spirit Urepk, hounded north
} by lands of .John Cashin, deceased, east by lands of
j Absdlom Rhodes, composed of two tracts, one of
one thousand acres, granted to J; ines Beall, and
another of two hundred acres granted to Janies
McManns.
I Also, all that other tract or parcel of land, situ
ate in same County ams State, containing fourteen
hundred and nearly two and three quarter acres,
more or less, together with Alills and improvements
' thereon, and bounded cast by lauds, lately own
ed by the estate of Lowe, west by lands now'
nr lately ownoed by Forkerbery, soiuh by lands
b- ught by one John Cashin, Senior, now deceased,
oorln by lands belonging to Absolom Rhodes. And
' the said petitioners further alleging that the said
j Johu,TroW bri.dge.has failed anj neglected to pay
said notes and has become insolvent, and that they
the said petitioners have paid them and that thbre
is now due them on said notes the sum of eighteen
hundred and forty dollars and fifteen cents, and
praying that the equity of redemption in and to
said mortgaged property may forever be foreclosed.
It is 'ofdered that the said John Trowbridge
pay in to Court on or before the first day of the
next term,the principal and interest due on sai.d
. mortgage, or shew cause Why the Eqiiityof'Re

, be forever barred and foreclosed against him; and
.. furthef, that a copy of this Rule be published in one
of the Gazettes of the City of Augusta, once a
