J ITPON the petition of John Whitehead, James J Whitehead ami Samuel Dowse, alleging that; on the thirtieth day of November eighteen hun dred and forty, John Trowbridge executed to them his certain mortgage deed whereby to indemnify and save harmless said petitioners, conveying two,- certaiu notes, made hy said Trowbridge to Isaac j. Bryan, dated on the 28ih day of August, A. Do eighteen hundred and forty-five, each for the sum! of eight hundred dollars, the one payable twelve months and the .other two years after date, signed by said petitioners as securities, he conveyed to I said petitioners certain tracts or parcels of land lying and being in said countVtff Richmond, the one being in the neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of James Whitehead, west hy lands of Joshua Key, and south and south cast b} the Bath tract. Also, two tracts conveyed by said John Trow bridge by Isaac Bryan and described as fi Hows, to wit; “All those two tracts or parcels of land situ ate, lying and being in the county of Richmond and State of Georgia, one containing twelve hundred acres, more or less, on Spirit Creek, bounded north by lands of John Cashin, deceased, east hy lands of Absolom Rhodes, composed of two tracts, one of one thousand acres, granted to J mes Beall, and another of two hundred acres granted to James sfc Manns. Also, all that other tract or parcel of land, situ ate in same county ami State, containing fourteen hundred and nearly two three quarter acres, more or less, together with 51illsand improvements thereon, and bounded east by lands, lately own ed by the estate of Lowe, west by lauds now nr lately owned by Forkcrbery, south hy lands br light by one John Gashin, Senior, now deceased, oor.h by lands belongingto Absolom Rhodes. And ihc said petitioners further alleging that the said John Trowbridge has failed and neglected to pay said notes and has become insolvent, and that they fhc said petitioners have paid them and that there is now due them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property may forever be foreclosed. It is ordered that the said John 'Trowbridge pay in to Court on or before the first day of the next term,the principal and interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not be forever barred and foreclosed against him; and further, that a copy of this Rule be published in one of the Gazettes of the City of Augusta, once a month for four months '>r served on the said John Trowbridge or his special agent or attorney, and al lowing three nfAilhs before the first day of the next term.
