July 13 16 John Whitehead, James Whitehead] aud Samuel Dowse, [ vs. ( 11 e ' I ‘~ l ' John Trow-bridge. j ITPON the petition of John Whitehead, James J Whitehead and Samuel Dowse, alleging that on the thirtieth day of November eighteen hun dred and forty, John Trowbridge executed to them his certain mortgage deed w hereby to indemnify and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on the 28? h day of August, A. i). eighteen hundred and forty-five, each for the sum of eight hundred dollars, the one payable twelve months and the other two years after date,signed by said petitioners as securities, he conveyed to said petitioners certain tracts or parcels ot land lying ami being in said county of Richmond, the one being in the neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of Janies Whitehead, w-est by lands of Joshua Key, and south and south cast by the Bath tract. Also, two tracts conveyed by said John Trow bridge by Isaac Bryan and described as f- Hows, to wit: “All those two tracts or parcels of land situ ate, lying and being in the county of Richmond and State of Georgia, one containing twelve hundred acres, more or ;less,ou Spirit Creek, bounded north by lauds of John Cashin, deceased, east by lands of Absolom Rhodes, composed of tw-o tracts, one of one thousand acres, granted to J; ines Beall, and another of two hundred acres granted to James McManus. Also a!' that other tract or paretd of land, situ ate in same county and Stale, containing fourteen hundred and nearly two and three quarter acres, more or less, together with Mills and improvements thereon, and bounded east by lands, lately own ed by the estate of Lowe, west by lands now nr lately owned by Forkerhery, south by lands bought by one John Cashin,Senior, now deceased, oorth by lands belonging to Absolom Rhodes. And the said petitioners further alleging that the said John Trowbridge has failed and neglected to pay said notes and has become insolvent, and that they the said petitioners have paid them and that there is now due them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property may forever be foreclosed. It is ordered that the said John Trowbridge pay in to Court on or before the first day of the next term,the principal aud interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not be forever barred and foreclosed against him; and further, that a copy* of this Rule be published in one of the Gazettes of the City of Augusta, once a month for four months or served on the said John i Trowbridge or his special agent or attorney, and al lowing three mouths before the first day* of the next term.
