Bank of the State of Georgia, )
Savannah, 20lh April, 1840. £
Sir : In addition to my communication of to-day,
which furnishes the state and condition of this Rank
and Branches, I herewith forward an extract from
the minutes of the Board of Directors, expressive
of their views with regard to the acts ol the lasi
Legislature, passed in December, 1839, the one
entitled “An Act, to amend an Act.more effectually
to secure the solvency of all the Banking Institu
tions of this State, passed 241 h day of December,
1832.” And the other, “An Act, to prevent the
several banks of this State from selling, or dis
posing of Exchange, at a higher rate per cent, than
herein expressed, under certain conditions, and to
prescribe the mode of punishment for a violation of
the same;” which is respectfully submitted.
And I have the honor to be,
Your obedient servant,
W. B. BULLOCH, President.
His Excellency, Chas.J. McDonald, Governor of
Georgia, Mtlledgeville.
At a regular meeting of the Board of Directors
of the Bank of the State of Georgia, on Friday,
20th March, 1340.
The following expression of the opinion of the
Board of Directors of this Bank, was adopted in re
sponse to the communications therein referred to,
and ordered to he entered upon the minutes.
A communication from the Office at Eatonton,
requesting “the views of this Board, in reference
to the law of the last Legislature, requiring an oath
in relation to the indebtedness of individual direc
tors,” was taken into consideration.
A letter received from Mr. Henry, Cashier of the
Branch at Augusta, was also laid before the Hoard,
communicating the opinion of the Directors at that
Office, with regard to the further requisitions upon
the Banks hy the two acts of the last Legislature,
by which tt appears that there is a coincidence with
tnose entertained here.
This Board determines to make the general re
turns of the Rank to the Legislature as heretofore,
agreeably to the law of the 24th Dec. 1832, and re
commend to the branches, to make each its separ
ate return of its state and condition, in conformity
with the first section of the act referred to by the
Eatonton Office, at the same time that they make
their return to the principal Bank,
’Fite Board of Directors confidently affirm, that
the further returns required hythe acts of the last
Legislature, have not been called for hy any im
proper conduct on the part of this Bank, and that
those acts seriously interfere with essential vested
charter, and individual rights,—and as this Bank
and the other Ranks of the city have made unceas
ing efforts to preserve a good currency, it is confi
dently hoped that the candid, fair and honest expo- j
sition which they have semi annually, made oftheir
state and condition, and which they will continue
to do, will sustain the reputation and high standing
of the Bank and all its Branches. The Board, how
ever, w ill be ever ready and willing to expose the
books, and exhibit the condition of the Rank, and
its entire management to the most scrutinizing ex
amination of commissioners that the Legislature
may appoint for that purpose, as they cheerfully
did upon a previous occasion, when a former Le
gislature directed an investigation into the affairs
of all the Ranks of the State.
A true copy from the minutes.
A. PORTER, Cashier.^,.
