PONihe petition of James Buchanan and Win
Hosier, stating that Aimer E Holliday, dec’d.
late of Burke county, died in the county of Murray,
on the eight day of September, 1834; by Ids certain
bond of that dale, a copy of which is filed in this
court, obligate himself lo one William Daniel, of
Morgan county, his heirs or assigns, titles to two
lots in thetown of Poinsct, known by the iYoB,
and one halt of No 16. And also by his certain
other bond, made in tho same county onthedlhday
of September, 1834, the said Abner E obligated
himself to execute |to the [said William Daniel, his
heirs or asrigns, the other half of said lot No 16, in
the said town of Poinset (a copy of which last
mentioned bond is filed in this court) and the said
James and Willi-un arc the assignees of said bonds,
and also that said Abner E departed this lite without
executing said titles; and praying this court to di
rect Matthew Jones, administrator of the estate of
said Abner E,, to execute the said titles lo the said
James and William. It is thereupon, on motion of
Multure Marsh, counsel for said petitioners, ordered,
that unless good cause he shown to the contrary,
that this court will, at July term next, direct said
administrator lo execute said titles. And it is fur
ther ordered, that this rule be published c~“* « K

PON tho petition of Dennis Carrol, of Murray
county, stating that Abner E Holliday dec’d,
of Burke county, tid, in the county of Munroe, on
the 6th day of October, 1835, by his bond of that
date; a copy of which is fifed in this court, bind him
self, his heirs and assigns, to execute to one Wil
liam Darnel, and his assigns, of Murray county, bv
tho first day of January, 1836, titles to that lot of
land known by the number one hundred mid sixty, 1
in the 10th district, 13th section, originally Chero
kee county; and staling that said Abner E departed
this life without executing said title; and that tho
said Dennis is the assignee of said bond; and
praying this court to direct Mathew Jones, the ad
ministrator on the estate ot said Abner E. to exe
cute title to said lot to the said Dennis. Whereup
on, it is, on motion of Mullbrd Marsh, counsel for
saiil Dennis, ordered, that unless good cause ia
shown to the contrary, that on the first Monday in
July next, this court will direct said admimistrator
to execute said title. And it is further ordered,
that n copy ot this rule be published once a month
for three months before said time.
