ON the petition of Thomas J Walton, praying the foreclosure of the equity of redemption ol I Gilbert Long street, in and to nil and sing!,Ur the lands, tenements and hereditaments hereinafter de scribed, to wit: all those two adjoining lots or pnr , cels of land situ to, lying and being on the comer of Jackson and Tels nr streets, in the city of Augus ta, and county and State aforesaid, bounded on the westby said Jackson street, on the Smith by soio Telfair, on the east by Samuel Hale’s lot, formerly Furey’s, and on the north by a lot formerly the pm petty ot Mrs. Mary Beaeh. Also—all the right, ti S tic and interest of the said Gilbert Longs reel, in and o all those several adjoining tracts, or parcels ol land, (including rno half of what is known as tbo ‘Lafayette Race Track,lsituale, lying and being near the said city of Augusta, in said State and county, containing two bandied and eighty acres, more or lass, bounded on the north by the Turknett Springs road,on the west by lands of Savage and ISttgg, and lands then or formerly Game's, on the south by lands of Wm H Turpin, and the estate of Ganges, arid on the south and cast by the Savannah road, which said several tracts or parcels of land were sold and convoyed to the said Gilbert Longstreet, by deed, from John 1 J King Wm T Gould, Alanha Furey,and Zenos Brinson. Also, all that tract or parcel of land situate, lying and being on the iva lera of Little Spirit Greek, in the Slate and county aforesaid, containing one thousand live hundred and eighty nine acres, more or less, being part of a irno; containing two thousand two hundred and s.xty five acres,known ns the Upper Mill tract, bounded on the north by lands of Lewis Harris, on the south and southeast by lands of 11 illiams & Kelly, and on tho west by lands of George Turknett and others • Also—all the saw limber belonging to the several tracts of land heretofore sold by James Beal, ex cepting two hundred and twenty acres, sold to Jere miah Winters, which said last mentioned tract of land, ([hereby conveyed, was sold and conveyed by James Beal to the said Gilbert Longstreet, hy deed,-bearing date the sixteenth day of December, eighteen hundred and thirty two, and also all that other tract or parcel ofLand situate lying and being ' ea the bant Swamp ol Savannah River, in the said Stale and County, containing one hundred and i -deceit acres, hoing the Eastern most half of a tract of land, sol'd hy the Executors of John Savage, deceased, to Willoughby Barton, and Dabney Hor sy, and which was bounded atthat time by lands be longing to Campbell & Turknett, which said tract «fland was conveyed by Wm. 0 Di lon, to the staid Gilbert Longstreet, hy deed, beating date tho sixth day of May, eighteen hundred and eigh teen. All of which said several luls,tracts,or parcels ■of land were, by the said Gilbert Longstreet, con veyed unto one John H. Mann, his heirs anil assigns, to secure the payment of a certain promissory note of said Gilbert Longstreeftpnyable to tlmsaiil John H. Mann or hearer, lor six thousand dollars,which said note, with the mortgage aforesaid, has been as signed to tho said Thus. J. Walton, who avers that there is nuw due thereon the sum ol five thousand r two hundred and forty dollars and sixty five cents, five thousand dollars, are principal and two hundred and forty dollars & sixty fivects,are interest accrued thereon down to llieday of the filing of his petition, to wit,this sixth day of July, Anno Domr.ni ; eighteen hundred and thirty seven, and the said Tho. J. Walton, praying the foreclosure of the Equity of Irodoniption of the said Gilbert in and to the said mortgaged premises. On motion of Henry H. Cttna ming, attorney of tho petitioner, it ts ordered that the Mortgager Gilbert Isingslroot,do,on or before the first day of the next Term, pay into Court tho prin cipal and interest due upon the above described mortgage or tho Equity of redemption of the said Gilbert Longstreet, in and to said mortgaged pre mises, he thenceforth forever barred, and foreclosed !llloral other proceedings take place, in conformity to the nets of the general assembly in such ease made and provided. And it is further ordered that this Rule ho published in one of the public Gazettes of this State, once a month for four mouths, or served •nlho mortgager, his special agent or attorney, at least throe months previous to the time the money is directed to bo paid.
