Provided further,- that all ap plications for licenses to sell spirituous or malt liquors at retail in quantities less than 5 gallons shall be read at one meeting of the Mayor and Council and then published as a part of tho proceedings of that meeting, and at the next subsequent meeting of the Mayor and Council granted or refused in the discretion of the said Mayor'and Council; k and no license shall be grant ed except as heretofore pro- Wvlded. f Provided further, that no minors or women shall be al lowed to enter, loiter or re main in any barroom where spirituous or malt liquors are sold; that no lunch counter or restaurant shall be permitted to be run or operated in the same building where said bar room is operated. By the terms “lunch counter’’ and "restaurant" it is understood to be a place or places where food is sold. Provided further, that no person, firm or corporation engaged in the sale, at whole . sale or retail, of spirituous vinous or malt liquors with in the incorporate limits of the city of Brunswick, snail open any place or places of business wherein any such liquors are sold or al- THE BRUNSWICK DAILY NEWS. lowed to be sold, or sell or dispose of such liquors therein or therefrom, or keep any such place or places where auy such liquors are kept or sold, open or sell any such li quors before 6 o'clock in the morning or after ten o’clock at night, Standard time, save and except upon Saturdays, when the same may be kept open and such liquors sold therein and therefrom until the hour of eleven o'clock at night, Standard time, at which time said places shall be closed and all busi ness cease therein. Provided further, tnat such place where spirituous, vin ous or malt liquors aro sold shall not have screens, blinds, or anything that might ob struct the view from the streets of the entire interior of such places of business, Provided further, that any pet son, firm or corporation vio lating any of these provis ions shall, upon conviction thereof before the police court of said city, be pun ished as Is prescribed in sec tion 16 of the amended char ter of the city of Brunswick, approved November 12, 18S9, (incorporated in section 71 of the code of said city complied by Owens Johnson, Esq., in 1900); and pro vided further, that in the event of any such violation and conviction thereof, the person, firm or corporation thus convicted shall be sum moned to appear before the Mayor and Council afore said, and unless said person, firm or corporation shall show good cause to the con trary to said Mayor and Coun cil, the license issued to said person, firm or corpora tion as herein provided shall be revoked and annulled by said Mayor and Council. Provided that no licenso shall he granted for and dur ing the year beginning Feb I, 1902 and ending Jan. 31, 1903 authorizing the sale of spir uous, vinous or malt liq uors at any place in said city located outside of that part thereof which is hounded as follows: Begin ning at the southeastern corner of Bay and G streets, thence south to the north side of London street, thence east 180 l'eet, thence north to the north side of Mansfield street, thence east 225 l'eet, thence north to the north side of Monk street, thence east 75 feet, thence north to the south side of Glouces ter street, tlience west ibi feet, thcnco north to south side of G street, thence west to point of be ginning. Provided further that no such place shall bp so li censed having an entrance on . tho said eastern bound ary lino between Monk and Gloucester street. SECTION III.—Be It further ordain- ed that the license or business tax provided for in this ordinance shalll run-from and include the first day of February, 1902, to and through the thirty-first day of January, 1903, Each license shall he in the name of the person or firm to whom it is Is sued and shall bear upon its face the words “not transferable, and no li cense shall be issued authorizing the carrying on of any business in tents within the fire limits of the city. Provided, that the person, firm or corporation taking out the license at any time on or after the first day of February, 1902, and before July 1, 1902, shall pay at that time for the en tire year; and all persons, firms or corporations taking out a license on or after uiily 1, 1902, shall pay for half a year. And provided further, that nothing in this section contained shall appy to organ grinders, flying ponies, centen nial boards, circus,circus parades, me nageries or acrobatic companies, they being otherwise provided for herein. All licenses shall be issued by the city treasurer, approved by the Mayor, registered and impressed with the seal of the city by the city clerk. SECTION IV.—Be it further or dained That so much of all ordinances and parts of ordinances fixing the rates of license, providing for collec tion of same, or otherwise regulating said licenses, not in conflict with tn.s ordinance, shall remain in full force and effect. And provided also, that nothing herein contained shall prevent the Mayor and Council from altering or amending this ordinance, or any part thereof, at any time. SECTION V.—Be it further or dained, That every dealer or other person taking license under this ordi nance shall keep said license exposed to view in his, her or their place of business, on penalty of being reported to the police court for a violation of this ordinance. SECTION Vl.—And be it further or dained, That, whenever, in the judg ment of the Mayor, it shall he neces sary so to do to collect the same, the Mayor Is hereby authorized to direct the clerk of the Mayor and Council to issue at any time, and the marshal to enforce, execution against auy person, firm or corporation subject to taxation or license charges under the terms of this ordinance. SECTION VII. —Be it further or dained, That each and every person, firm or corporation, who shall engage In any business, trade or calling, pro vided for herein, who shall become lia ble to pay any tax or license prescrib ed herein, shall conform to and comply with the following section of the code of ordinances of said city, as compiled aud codified in the year 1900, which same is as follows, to-wit: “Section 840. —Every person, firm or corpora tion engaged in any trade or business in said city is hereby required to reg ister his, her or its name, business, calling or trade, annually, at such time as the Ma w or and Council may, by resolution from time lo ~me, di rect. in a book to be kept by the clerk for that purpose; and persons coming Into me city and engaging in business after that uate, shall so register with in ten days after commencing any bus iness, trade or calling, and take out the required business license.” SECTION Vlll. —Be it further or dained, That any person, firm corpo ration violating any of the provisions of this ordinance, or carrying on busi ness without having first obtained the required license, shai,, on convic tion thereof before the police court of said city, be punisned as prescribed in section 16 of the amended charter of the city of Brunswick, approved November 12, 1889, (incorporated un der section 71 of said Code of Ordinan ces). SECTION IX. —Be it further or dained, That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed. Adjourned. N. D.
