An ordinance regulating the laying of side-tracks on the east side of Bay r street anu other streets, lanes and alleys in the city of Brunswick, and for other purposes. Be it, and it is hereby ordained, by the Mayor and aldermen of the city of Brunswick in council duly assemb led, That the railroad company own ing and controlling the railroad traca on the east side of Bay street, be, and it is hereby authorized and empower ed to construct side-tracks connecting with such track on the east side of said street, between Howe and Glou cester streets, except 270 feet south ot Monk street, under the following conditions and provisions, to wit: (a) That the side-tracks be run as near the sidewalk as practicable, and that there he at least one switch con nection w>t.h the main line of the said railroad in each block. (b) That the ties be sunk below the grade of the street, so as to make the rails practically flush with the street, anil that a plank or deal three inches by nine inches, be placed on oacli side of the rails, and that shells or other paving material approved by the committee on public works be laid between the rails. j (c) That such side-tracks be used exclusively for the receiving and de livery of freights from and to con signees having places of business ac cessible 10 such silo Hacks and not for the storage of cars, loaded or un loaded . I (and) That all consignees or ship* ' pers using such side-tracks he re . quired to unload and load cars on such side-tracks with all reasonable despatch, so at to event the block ading of said tracks or the street as far as possiblo. (e) That said railroad company, its successors and assigns, he always re quired to switch, deliver and receive freight In carload lots for, to and from persons having places of busi ness located and fronting on the east side of Bay street on the blocks where such side-tracks aro so constructed, which are transported to Brunswick over the line of said company, without extra charge for such switching ser vice, Said railroad company Bhall in like manner also deliver to and re ceive from such persons so doing bus iness, or who may hereafter have such places of business on said blocks, all cars of freight in carload lots trans ported or consigned over the line of any other raiload company or com panies now naving a railroad line or lines in said city and having track connection within the corporate lim its of said city witli said railroad company owning and controlling said track on the oast side of Bay street, and which may be tendered to said last named railroad company by such oiner railroad company or companies, at and for a switching charge not to exceed two dollars per car. And this provision shall likewise apply to any other railroad company or companies which may hereafter construct a line or lines in said city and have side track connections with said railroad company having and controlling the track on the eastern side of Bay street, its sucessors and assigns. (f) The railroad company so own ing and controlling such tracks, and such persons who may now or here after have places of business on such blocks and make use of said side tracks in shipping and receiving freights, are and shall forever be sub ject to all ordinances and resolutions of the Mayor and council of the cit.v of Brunswick now in force or which may hereatter be enacted, governing and regulating the use and construc tion of such side-tracks. (g) Wilful or peristent violations of the provisions of this ordinance, or of the ordinances governing such side tracks and the operation of trains tflereon, shall authorize the Mayor and council to revoke the rights, priv ileges and franchises herein granted, and to cause such side-tracks to be re moved from the streets. A failure or refusal of the railway company owning or controlling such side tracks to remove them, in t..e event of such forfeiture shall authorize the removal of the same by the Mayor and council at the expense of such railroad company. Cfi) In the event it becomes nec essary to lay or repair any sewer or water or gas main or pipe on such portions of said street where such side-tracks are constructed, the rail road company owning or controlling the same shall not in any way inter fere therewith, and if extra expense in so laying or repairing such mains or pipes is occasioned by the con struction of such tracks, by the ne cessity of constructing braces or studding to hold up such tracks, sue l ' extra expense shall be borne and paid by said railroad company. (ij The provisions, of paragraphs (e), (f), (g) and (h) of this ordinance shall be applicable to and govern the use of each and every railroad sid traek v hieh the Mayor and council may permit or authorize to be con structed in any street, square, lane or alley v.ithin the corporate limits of tuis cily and which shall be connect ed with the track of any railroad com pany for the purpose of making deliv eries of freight to or receiving ship ments of freight from any person do ing business within such corporate limits. (j) Said railroad company so own ing arid controlling such track on the east side of Bay street shall befrev laying or constructing such side tracks or any of them signify its ac ceptance and agreement to the terms snd provisions herein made in writ ing, signed by its chief executive of ficer. Section 2. Be it further ordained by the authority 'aforesaid, That ail ordinances and narlt of ordinances in conflict herewith be and the same are Hereby annulled and repealed. Clerk Must Be Furnished With Re turns of All Property. “All persons claiming or owning property, both real and personal of every or any uature or sort in the limits of the city of Brunswick or who are engaged in any sort of bus iness, shall furnish the clerk with a return under oath of all property both real and personal in said city, owned or controlled by him, her or them on the day designated by the law of the city." * * “Any person making a return ot real property, may at the time ot making such return with the con sent of the Mayor and council, direct in writing that his return as to par cels of real estate included therein shall stand and be his return of the same for every years thereafter and until be shall alter suen his return by adding other parcels thereto or striking therefrom, seme of the par cels included in the same.” * * * "All persons transferring or acquir ing real property shall notify the clerk in writing of the fact of such transfer, and the names of the trans ferrers and transferees before the first day of April, and in case trans fers of real property shall not be so notified to the clcik then me same may be taxed as the pi\.>e;ly c: person last returning same, and shall be subject in like manner as u no transfer liaii been made.’' * * * "If there is any real estate not so returned by the first day of May it shall bo the duty of the clerk to is sue execution against suen real es tate as unre turned property.” * u Referring to the above extract.-: rrn : Sections (il and 336 of the City Code, i beg to notify the public that the re turn book will be opened March 1. The hoard of assessors of the city of Brunswick have this day filed their return of assessments for the year 1902 in the office of the undersigned, as required by law. “Twenty days (20) days, from March 1, are allowed in which to file complaints against property so assessed.
