'THE REVISED 1 6 & 6,ORDINANCE Continued from Page 1.) continuously maintain such retaining walls of durable character and ma terial along the outer edge of the side walks of each street the grade of which is altered and which lias been so changed in order to permit the laying of its tracks thereon as will prevent tile said side walks from crumbling or in any manner becoming dangerous to persons traveling there on and also erect and maintain such suitable and safe railings or other safe guards upon the outer edge of such side walks as will prevent per sons using said side walks from trav eling outside the same and avoid any danger of any persons falling from saiii sidewalk. Provided iiirther that if any loss, injury or damage is sus tained or alleged to lie sustained by any person either during the construc tion of tlie railroad tracks provided for and authorized by this ordinance arising from or growing out of the laying of said tracks or from th<> operation of said railroad company’s trains thereon men the same shall be paid by said Brunswick and Birming ham Railroad Company, and the May or and council of the city ot Bruns wick shall not be in any manner re sponsible therefor and if helu liable therefor by any court then the amount of such liability shall be promptly paid over by said railroad company, and the said Mayor and council of the city of Brunswick shall be held liarmiss in the premises. Sec. 11.—Be it further ordained, That no trains, engines or ears op erated by said railroad company shall be allowed to stop or stand on said track where the same is constructed across E street, or on the crossing between the Oglethorpe hotel and the union passenger depot. Sec. 12.—8 e it further ordained, That the Mayor and council shall have (he authority to prescribe and regulate the time and manner in which freight trains shall be permit ted to be operated and run on said track, between C! street and the Southern side of F street; provided, that no freight train or freight cars shall be permitted to pass over said company's track between said G street and the southern line of K street, for and during a period of fif teen minutes prior to the leaving and arriving time of passenger trains trom the union depot as fixed by the sched ules of the Sompanies using the tracks leading into said union depot. Sot'. 13.—8 e it further ordained, That the rights and privileges herein granted and given upon the express condition that the Mayor and coun cil shall have full light and author ity to revoke, forfeit and annul the pany ever pass into the eoiuroT'7>f ownership of, or be operated by, any railroad company (or the successors or assigns of such company) now having a railroad line in said city, or if said railroad company should ever pass into the ffitfitrol or ownership of or he operated by any railroad cor poration, which may liereaft -r con struct lines into said city. Should the Mayor and Council elect so revoke and annul the rights, priv lieges and franchises herein granted, in such event (which may be done either by resolution or ordinance) it Is expressly understood that said railroad company, its successors oi assigns, shall cease to operate trains on its tracks which may he laid on the streets specified in this ordinance, and shall remove such tracks from such streets within thirty days after the adoption or passage of such res oution or ordinance; and should said company, its successors or assigns, refuse or tall so to remove such tracks, in such event, within said thirty days, then the Mayor and coun cil shall have the right and authority to take u)i and remove such tracks, as laid on said streets, summarily, an at the expense of said company, its succesors or assigns. See. 14.—8 e it further ordained. That before said Brunswick and Bir mingham Railroad Company shall have the right to lay such tracks on any of the streets specified herein, the chief executive officer of said company, on behalf of said company, shall signify in writing the acceptance of such rights and privileges under the terms and conditions herein named, which acceptance shall Im spread on the minutes of council. kec. 15. Be it further ordained, That if said railroad company or its successors or assigns shall at any time wilfully or persistantly violate the obligations and undertakings im posed upon and assumed by said com pany under the provisions and terms of this ordinance, said Mayor and council shall have the right and au thority, at its option, to revoke and annul the rights, franchises, privi egxs and license herein granted, and in such event, said railroad company its successors and assigns, shall for elt any and all rights, privileges, franchises and license herein granted provided, that nothing in this section shall be construed as authorizing tne slightest violation of the terms and conditions set out and prescribed in section 13 of this ordinance. Sec. 17. Be it and it is further or laineu that in the event any break or injury is caused to any of the sewers or drains upon the streets traversed under the authority of this ordinance by the. said railroad com pany in the construction of this line or the work incident thereto cr by the operation of its trains the said railroad company shall promptly re pair or cause to be repaired under the suervision and direction as in the preceding section provided for. all such breaks or injuries and if it shall fail or refuse to do so promptly then the said Mayor and council shall cause the same to be done immediate ly and the cost of doing so shall be borne by iqe said railroad company i it being distinctly the true intent and meaning of this ordinance that said : railroad company shall hold (lie said Mayor and council harmless as to any . and ail damages, cost or expense in i urred thereby directly or indirect!) i by the laying of its track any work incUK nt thereto and the running and ! iperation ol its trains and generally [ arising from its use and occupation ' ol the streets provided lor by this I ordinance. Hoc. j,B. in ihe event any dispute, uisagre, ment or controversy arises at any lime as toany liability or alleged liability upon (lie part of said rail road company based upon the two preceding paragraphs of this ordinance then such dispute, disagreement or controversy shall be referred to the arbitrament and award of two civil engineers, one to lie selected and chosen by the said Mayor and council and the other by the said railroad com pany, and if the two thus chosen and selected shall fail to agree then they shall select a third civil engineer and the three thus chosen shall determine the question submitted to them the decision or a majority of the number being sufficient to decide the question submitted to them, and upon the mak ing ol tneir award the same .shall be ■ lone and performed by the parties concerned to-wit: the said railroad company and the said Mayor and council promptly and in good faith.
