FRIDAY g MORNING STREET CAR At its meeting Thursday night, April 10, the city council placed on its third and iinal reading and adopted the following ordinance: An ordinance, entitled an ordinance to grant unto L. B. Treadwell, Ho bart C. Fash, and Geo. M. Veacelius, . their associates and assigns, a right and franchise for the construction, maintenance and operation o£ a street railway system and electric light and power plant in the city oi Brunswick, Ga., and for other pur poses. Section I. Be it ordained by the Mayor and council of the city of Brunswick, Ga., in council lawfully assembled, That the said Mayor and council of the city of Brunswick does give and grant unto L. B. TreadweJ, Hobart O. Fas'n and eGo. M. Veacelius, their associates and assigc ud like wise any corporation winen they m{iy hereafter organize, tne full power, easement, rigut and authority to build, construct, equip* maintain and operate an electric street railway over, upon and through the following named streets 01 the city of Bruns wick, Ga., the same to be known as the initial line, that is to say, from the intersection of Mansfield with Newcastle, along Mam;Held east to Union, douth along Union to oart mobnt, west along Dartmouth w Bay; north along Bay to ■>we, east along Howe to Newcastle. Loca pion, plans and profiles ot all tracks and sidings shall be submitted to the city engineer ai least three days lie fore work of construction shall begin, and ail such tracks and sidings and ail poles shall be constructed and erected under the direction and super vision of ~e Mayor, the chairman of the committee on public works and the city engineer. All poles, if re quired, shall he provided with one arm for the wires connected width tne po llee and fire aiarm signals, without cost to the Mayor and council. Section 2. .He it further ordained, hy the- authority aforesaid Thai the anti assigns or any corporation which said named persons, their associates they hereafter may .form, (except w here cars are cnartereu for specia! purposes) shaii . in no ease collect from any passengers more than five cents for one continuous passag with ordinary hand baggage Detween any two points within the city limits, to include transfers at the junction points: provided that the passenger or passengers so transferred shall take the first car leaving after his or her arrival in the direction in which he or she wishes to go, and provided that such passenger or passengers has sufficient time to transfer to such first car. (This section is not to be construed as allowing such pas senger a round trip, but is simply a single trip from one point to another by the. shortest and most direct route,) Section 3. Be it furtner ordained. That the road-bed of said street rail way shall at all times correspond with the actual grade of the streets, and that the top of the rails shall be so iaid and maintained flush with the surface or grade of [he streets, so that carriages and other vehicles can eas ily anif freely cross sain tracks at any and all points. Section 4. Be it further ordain ed, That the right -and privilege hereby granted in so far as it affects Bay street, shall not prevent the May or and council at any time having and exercising the. right to permit ali oi said street to be used by steam rail roads, and to require the tracks of said street railway to be removed therefrom. In such event the actual cost of removal and re-location of the line of such street railway shall he paid by such railroad company or companies that may be granted such use of sam Bay street as will require such removal of t'ne tracks of the Said street ra,iway. Section 5. Be it furtner ordain ed, coat in addition to the advaiorem tax which may oe lawfully levied an< collected on such street railway and all the property and franchises of such persons, their suceesors and assigns, by said Mayor and council, said Der ons, their successors or assigns, or whoever shall control,own and use the rights and franenises nerein granted, shall pay to the Mayor and council each and tor every year after five years from the passage of this or dinance, the lollowing percentages of the gross earnings of 3uch elec tric railway and electric light and pdiver plant, to wit: After five years from the passage of this ordinance and for five years thereaf ter, one-half of one par centum of such gross earnings; for the next suc ceeding five years, one per centum of such gross earnings; provided the pop ulation of said city, according to the census therm r as taken by the United States government in the year 1910, shall be not less man eighteen thous and, and it such population be less than eighteen tnousand by such cen sus, then tor such period of five years three-fourths of one per centum of such gross earnings for each year; thereafter, and until the year 1930, one and one-haif of one per centum of such gross earnings provided that the population of said city, ac cording to the census thereof first taken by the United States govern ment alter the census of 1910. shall be uot less than thirty thousand, and . the population by such census be less than thirty thousand, one per centum ot such gross earnings, each and ev ery pear until the year 1930; trom the year 1930 ana each and every year thereafter until the expiration ot the term of this grant, two per centum of the gross earnings, without regard to the population of said city, pro vided that such railway and power plant and the properties and fran chises of such grantees, their suc cessors and assigns, snail be exempt nun aav advaiorem tax by said city for ten years from January 1, 1903; provided mrther, that such persons, company or corpoatioh shall furnish in writing to the Mayor and council by the 31st day of December in each yar after the first five years from the date of the passage of this or dinance, a statement of such gross earnings. And the Mayor and council shall have the right to designate some tit and discreet person to examine the hooks and records of such persons, company or corporation to verify such statements. * Section ti. Be it further ordained, That the operation of such street railway shall be subject to all ordi nances now in force or which may hereafter be enacted governing and regulating the speed and running of electric cars in said city. Section 7. Be it further ordained, That the rights, franchises, powers and privileges herein granted may be exercised ny the said grantees, their successors and assigns, tor and during the term of fifty, years from the date of the passage of thiß ordi nance, unless sooner terminated and foneited under the terms of this or dinance* Section S. Be it further ordained, That the rights, powers, franchises and privileges Herein granted shall cease, determine and be forever void if the said grantees, their successors or assigns, fail to begin, in good faith, (he work of constructing such street railway system within four months from the passage of this ordinance, and unless sai,. grantees, their suc cessors or assigns, shall, within twelve months from such date, have constructed and in operation at least four miles of such electric railway system within the limits of said city. Section 9. Be it further ordained, That the franchise and license grant ed in this ordinance are. subject to the ngnt and power of the city gov ernment to compel the grantees, their ■associates, successors and assigns, to pay tne cost of paving the portion of any street or streets, alleys or other highways in said city used aurl occu py u by any such tracks includ ing tl* space between the rails and eighteen inches from the,- outer side oi the rails, whenever said Mayry and o<?lineil shall require the paving of anY of the streets along winch stte'rr tracks- shall be laid. The Mayor and ff ineil shall designate the kind and quality of paving material to be used, and such paving shall be done under ih ■ supervision of tine city engineer, superintendent, of public works, or any other agent, or official designated by the Mayor and council. Whenever repairs are to be made to said tracks, or whenever . .0 streets are torn 11a or paving removed for the purpose 01 inakfng repairs, such grantees, their associates, successors or assigns shall make such repairs as promptly as possible and shall immediately thereafter put the streets iri as good order and condition as they were be fore suc’n repairs were made. In con structing the initial line on the streets herein designated, said grantees, their associates, successors and as- hlihl I, as soon as prae ricablo after such tracks are laiit. put; the portions of the streets ns.Ml in at least as good condition as they were before the laying of such tracks, using the same material on .-.an! streets, or any other material which may be satisfactory to the city authorities, under whose supervision such work shaii be done. Section 10. Be it further ordained. That the said Mayor and council of the city of Brunswick does grant and give unto said parties, their associ ate.-f, succetfeor* and assigns, and likewise! any corporation win 1) they may hereafter or ganize, the fuii right and author ity to build.', construct, purchase, equip, maintain and operate an elec tric light plant, for the purpose oT furnishing and supplying to the said city of Brunswick and the inhabi tants thereof and to other people electric light and electrical power, in such quantity and such po-wer as may be desired, and to that end they are hereby authorized to plant, erect and maintain all necessary poles and to lay or stretch and ma terials or appliances necessary to the delivery or furnishing of lights and power by electricity from their electric plant or plants to the city or Inhabitants thereof or other peo ple, over and'upon any and all of the streets alleys, squares and greens of said city, either under or above ground or both, as the said persons' may cesire; provided, however, that too rights, privileges and powers set out, and granted by this section shall be subject to all ordinances now in force or which may hereafter bet adopted regulating and controlling the use of such streets, lanes, alleys squares and greens, and the erection of poles and electric wires. NEWS nance; but it is provided, however, that in so' laying the wires and con structing the poles for fno purposes above named, the licensee’s'shall not build any obstruction over the said highways, squares <y greens of said citjl which will interfere with tiie public in its use of the same as a highway for vehicle or pedestrian. Section 11. Be it furtner ordained, That should the said grantees, their successors or assigns, fail or refuse to perform the conditions or comply with the terms and provisions herein set out and imposed upon and assumed by them under this ordinance, then, in such event, the said Mayor and council may, at its option, annul and revoke, this franchise and all of the rights, powers and privileges herein granted. Section 12. Before said grantees, their successors or assigus, shall have the right or authority to exercise any of the rights or privileges herein granted, they, or one of their num ber duly authorized*by them in writ ing, shal! signify the acceptance of this ordinance and the terms and con ditions herein set out, in writing, whicn acceptance shall be spread on the minutes of council, and such ac ceptance shall give this ordinance and all its terms and conditions not only the force of law, but also the full force of a contract between the Mayor and council and said grantees, their successors or assigns. Section 13. Be it further ordained. That should said grantees, their suc cessors or assigns, or the persons or corporation owning and controlling such street railway, after once be ginning the operation of tile ■ same, fail or cease to operate such railway in such manner and with such sched ules as will afford the public fit and reasonable transportation facilities for a term oi four mouus, then, in that event, the Mayor and council shall have the right to revoke anil annul this ordinance and the lights and privileges herein gran tea. Section 14. Be it further ordained, That said grantees, t.heir associates, suecesors nor assigus, shall never have the right, to be allowed to trans fer, sell or lease the rights, fran chises and privileges hereby granted, or such railway property, power plant and other property connected with such street ailway, to any person, firm or corporation which may here after be permitted to lay, control, own, and operate a street railway within the incorporate limits of said city, nor to consolidate with any such person, firm or corporation, without the consent of the Mayor and cunci! of said city evidenced by a duly en acted ordinance. Section 15. In constructing and lay ing such railway tracks an . such oth er tracks as may hereafter be permit ted, and in the running and operation of cars theeon. said grantees, their associates, successors and assigns, shall gioid the Mayor and council of said city harmless for any and all damages and injuries to persons /and property; and if the said Mayor and council snail ever bo. held liable in any court for damages in any such injury or damage to persons or prop erty, caused by the laying of said tracks, excavations in the streets in and about the construction qr repair ing of such railway, or the running and operation of said cars, <* by any act or deed of said grantees, their as sociates, successors and assigns, or by the perons constructing and operat ing such railway, then ami in such event, tue said grantees, or the per son or company owning and operat ing such railway, shall immediately pay to the Mayor and council such amount for which verdict or judgment may be rend ere-., and upon failure so to do, the Mayor and council shall have the authority to revoke the fran chises, privileges and rights herein granted and given. Section 16. tie it further ordained, That such persons, their associates, successors or assigns, shall he re quired to pay all costs of repairs ii' any, to the public ewers and to the water and gas mains as now laid on any of said streets, caused by the construction of such tracks, and should it at any time in the future become necessary to repair- any of the public sewers, or to lay any new sewers, along any portion of any of said streets where such tracks may be so constructed, suen persons, com pany or corpoation snail Be eqHired to pay any extra cost which it may 'no necessary to incur in making such repairs, by the erection or placing of studding or braces to hold up such trails while such repairs are being made.
