The automobile Is evidently firmly
established in France. In a recent
suit for damages resulting from a run
away which turned out fatally, too,
the court held that the horse should
have been accustomed to the sight and
sound of motor vehicles, and the
chaeuffer was absolved of all respon
sibility.
Council did not take any action
about the condition of liay street at
the meeting held Thursday night, but
we iiope the matter will soon be at
tended to. All we ask of the members
of councl Is this: Take a drive over
the hoggy section. The News will fur
nish a turnout and after that drive it
will be only a short time before the
street will get some attention.
During a trial at Evansville. Indiana,
recently, for the custody of a two-year
old child that had been placed In a
children's home, the mother, a Mrs.
Martin, carried the infant off with her
to Hawkesville, Ky„ her former home.
An officer was dispatched after her by
the court, and serving his order, he
seized tne child and started for the
train. A crowd of citizens promptly
fcathem\ taoever, and taking his
prize awty from him restored It to
the mother. There is little question us
to where the sympathy of a crowd lies
In a case of this kind.
CA3E OF MAJOR WALLER.
It seems impossible to find out on
what grounds the acquittal of Major
Waller by the courtmartial 'was based.
He was tried on the charge of execut
ing without trial a number of natives
of Samar, and there have been cur-
rent In this country two explanations
of the acquitttal—explanations which
were offered before the acquittal was
an accomplished fact, and upon which
little light has apparently been
thrown since the conclusion of the
trial. On the one hand, there was
the excuse that Major Waller was in
a condition of exhaustion, physical 11l-
ness and mental unbalancement, due
to extraordinary and protracted hard
ship, which made him not respeonsi
ble, or not fully responsible, for his
acts. The other view was that the
circumstances of the campaign were
such as to warrant the execution of
natives without trial, a plea which
evidently was made by the defense in
the case, since the citing of General
Jacob H. Smith’s now famous verbal
orders to Major Waller was one of
the leading features of the trial. The
people who have been most indignant
over the so-called "attacks on tho ar
my" made by persons opposed to a re
sort to barbarous methods by the Uni
ted biates officers and troops have, as
a rule, taken boldly to the second ex
planation; others have fallen back
upon tho personal condition of Major
Waller.
Apparently, General Chaffee is about
as much in the dark as to the state
of mind of the military court as any
.MXty else. In his review of the ver
dict of the court-martial he approves
"as much of the findings ot the court
as are to the effect that Major Waller
is not guilty of murder,’ basing this
approval on the fact that. Major Wall
er, at the time of the commission of
the offense, "was sick, prostrate from
a fever, Buffering acute pain of body
due to exposure and his exertions In
behalf of his men and mental anguish
concerning their fate, which had long
been in doubt.” But he is “at a loss
to understand why the court did not
find against Major Waller in the mi
nor offense',” meaning aparently his
ordering the execution without first
consulting General Smith with whom
he was in telephonic communication.

The following ordinance was read
the second and third time, pas.-a t! and
adopted, as follows:
An ordinance to levy and assess a tax
for the support of the government
of the city of Brunswick ior the
year 1902, and for the payment of
the ordinary an l extraordinary ex
penes of said city for said year, and
for bther purposes:
Section I. . .Be ondained by yhes
mayor and aldermen of the city of
Blrnuswlck, council Jjuly asem
bled, and it is hereby ordained by the
authority of the same, that for the sup
port of the government of the city
of Brunswick for the year 1902 and for
the payment of the ordinary and ex
traoiumary expenses of said city tor
said yqar.a tax of one ane forty-hun
dredths (1.40) per centum of the value
of the taxable property within said city
he and the same is hereby levied and
assessed on all property taxable by
said city, and shall be paid by the
several and respective owners of the
same in two equal payments, one on
or before the 30th day of June, 1002,
and the other on or before the 30th
day of November, 1902, provided, any
tax jiayer shall have the right to pay
his or her whole tax at the time the
first installment Is due; and provided
ftuMkgfr, that should any person or
pflfWns. liable for suen taxs, fail so
to pay one-naif of any and ali taxes
due sai.l city for said year by the 31st
day of July, 1902 the entire amount of
such taxes due for the year shall ini-
mediately become due, and it shall be
the duty of the clerk or council to

enforced by levy and sale, as provided
by tint charter, ordinances and by
laws of said city.
Section 2. Be it further ordained
by the authority aforeaid. That one
half of one per centum of such taxes
shall be levied and collected for the
purpose of paying the ordlntry cur
rent expenses of said city for said
'year, and three-fourths of one pet
centum for the payment ot the prin
cipal and interest of the public debt
of said city, and fifteen hundredths of
one per centum for paying and merad
amlzing the streets.
Section 3. Be it liirtber ordained by
the autnortty aforesaid, T.iat this or
dinance shali be subject to amendment
and the right is hereby reserved to
levy an additional tax for said year.
Section 4. Be it further ordained by
the authority aforesaid, That all or
dinances and parts of onfiaanees in
conflict herewith be and the same are
hereby apealed.
