Paris, Hi., the old queHi-n of the right of a railroad to enforce a claim for demurrage by Hen upon the lumber involved baa again come up and been decided against the railroad. In this case the Propst Lumber Cos., of Paris, received a carload of lumber but did not succeed in getting it un loaded within the time prescribed 'ey the railroad. Consequently a charge of $1 for demurrage was made, which the company refused to pay. The rail road thereupon seised the car of lum ber upon which it claimed the cnarge was a lien and held it. The lumber company sued for the value of the lumber in the car in the circuit court, without, jury, the arguments being made on the legal aspects of the case. The court, upon the conclusion of the arguments, promptly gave judg ment In favor of tne lumber company in the full amount of its claim, sr,B2 presumably in conformity with the ruling of the supreme court, of the state, which declares that demurrage Is In the ature of a chaige for storage which is outside the province of the railroad company to enforce by lion. 1 The subsiance of decisions has been (hat In order to collect a demurrage charge the railroad company must pro ceed hy suit, it is,, also to be Inferred from the decisions that In case p < ar Jm is not unloaded within a reas* Table time the railroad may store the con tents and a charge for that, storage might then become a lien, but the rail road company as such is not iri the storage business.
