utes of council for 1878 and 1877 do
not contain any reference to such a
lease, and if such lease was recorded
in the office of the clerk of the super
ior court, such record is lost, as the
books for those years were burned,
according to Clerk du Bignon.
Council minutes of Sept. 2, 1897, re
cites: “Petition from Kaiser Bros.,
and others, to adjust back lease on
foot of London street; referred to
taxes and revenues committee with
power to act.” No report of the com
mittee is recorded on the minutes,
but the stub of lease book receipts
shows a payment on Sept. 8, 1897, of
$250 by Kaiser Bros, as compromise
settlement of lease on foot of London >
street to April 1, 1898 per authority I
of mayor and council. Council minu
tes Oct. 27, 1897 recites; “Petition
from Southern Pine Cos., asking that
last 10 yews rental A foot of Londo n
street be adjusted. Referred to har
bor committeie, who reported as per
minutes of November 11, 1897,
as follows: Fixing the an
nual rental for the last 10 years
of the present lease of the foot of
London street at the rate of $75 per
annum. Adopted.” I am advised by
Mr. A. C. Banks, the agent, and W.
E. Kay, Esq., attorney for the South
ern Pine Cos., that the original lease
to Cook Bros. & Cos. was not deliver
ed to the company by Mess. Kaiser,
et al at the time of the transfer. It
would appear from the foregoing that
the council of 1897 recognized the
lease expiring April 1, 1908, but as
there in no copy of either lease on
tile In this office it is impossible to
• know anything of the conditions and
. provisions thereof. ,
Foot of Prince street —Leased on
January 19, 1866, tot John H. Gordon
for 30 years, S2O for first five years,
S6O for next 15, remaining 10 by ar
bitration. The assessors fixed rental
for lent 10 years at SBO. Lease was
subsequently transferred to Littlefield
& Tilson. Was leased again on 18th.
day of January, 1896, to James S.
Wright for 20 years, at SIOO per year
for first 10 yfcars. Improvements to

ject to taxation. Improvements to
revert to city upon termination

It appears from the records that

The arbitrators, in 1886, assessed rent"

the wharf on the premises at SIOOO.
(Under original lease, city was to pay
for wharf on premises at expiration.)
On December 22, 1894, the property

Machine & Mfg Cos., transferees of

Novemiber 28, 1894, at $75 for first

Cancellation of Original Lease.

of lease and with each, and every con
riition. lease can be declared void and
posession of said premises taken with
out resort to legal process.
No stipulation as to whether ini
provements shall revert to city or
lessee shall be reimbursed.
On August 15. 1902. new contract
of lease was drawn up but never ex
ecuted on part of lessee, R. E. Briese
nick. The conditions named were:
Term tf 50 years, at SIOO per year
for first 25 years, oilier 25 years to

1887, by B. & W. R. R. Cos. for 99
years, for S2O per year during the

leased on the 22nd day of December
1888, to the B. & W. R. R. Cos. for
60 years, ait $l5O per year for the
whole, payable semi-annually.
Conditions: Forfeiture for arrears
or default in payment of lease.
Provisions: 1 Railrqad to ereot and
maintain suitable landing dock or
wharf for smal’‘ boats at the foot of
either of the folk>w,ing streets; J, K,
L or M, at the election of the rail
road, which said landing dock or
wharf shall 'be open to and for the
use of the public, without let or hin
drance, to be kept and maintained
for the full term and period.
Lease to be immediately forfeited
In the event of transfer without first
having the consent of the mayor and
council.
No stipulation as to improvements,
whether to revert to city or city to
reimburse lessee.
Foot of I and J streets were leased
tot J. D. Sprunt for S2O per annum on
Feb. 27, 1880, for 20 years. Lease
subsequently passed into control of
the Downing Cot. This lease expired
in 1900. I found on further investi
gation that the streets named therein
were included in a lease to the B. &
W. R. R. to all the streets north of
F street, dated Dec. 22, 1888 for 60
years. According to the records, both
lessees have paid rental since 1888.
The Downing Company advises that it
is their impression their lease to I
and J streets was renewed, but thus
far have been unable to find the pa
l>ers. There is nothing on file in this
office to indicate such renewal, al
though the Downing Cos. has paid rent
al up to 1903.

utes, until the day after such meet
ing, provided he shall furnish such

3 Ordinances.
By the mayor. On first reading:
An ordinance granting to the Ten
■ nessee District Telegraph company
of Tennessee, its successors or as
cigns, the right to enter upon the
streets, lanes and alleys of the city
of Brunswick, Georgia, for the pur
pose of erecting and maintaining
poles or other supports upon, along
and across said streets or highways,
And to place and maintain thereon
wires, cables and other appliances
for the purpose oif conducting a tele
graph or messenger signal business.
Section 1. Be it ordained and en
acted by the city of Brunswick, Ga.,
and it is hereby ordained and enacted
by the authority of the same, that
tho privilege and right are hereby
gran tied to the Tennessee District
Telegraph company, of Tennessee its
successors or assigns, to enter upon
the' highways, streets, lanes and al
leys of the city of Brunswick, to
erect and maintain poles or other
supports upon, along and across said
highwavs. streets, lanes and alleys,
and to place, maintain and operate
thereon such wires cables and other
apliances as may be necessary and
proper for conducting, conveying or
transmitting electricity for the trans
mission of a telegraph and messenger
signal service or business, and also
to extend the said wires, cables or
other appliances to and into buildings
Upon or near the *W highways,

the said system of distribute :
communication.
'Sec. 2 The said Tennessee District
T elegrapli company, its Successors or
assigns, shall have the right, subject
to the supervision and direction
of the superintendent of the fire
and police deparement, to make
wire connections between its offi
ces and the fire department house:,
and to install therein signal boxes
or the purpose of transmitting thereto
fire alarm and police signals received
at its offices over its wires.
Sec. 3. In consideration whereof,
the city of Brunswick shall have the
right to use tbe top cross of
arm of all poles erected by the
said Tennessee District Telegraph
company, its successors and assigns,
in said city, and the further right
to the use of said poles, for the at
tachment thereto of the city's fire
alarm boxes, both rights to be enjoy
ed free of charge to said city.
Sec 4. That any ordinance or part
of ordianace conflicting with the
provisions of this ordinance be and
the same is hereby repealed so tar as
the same affects this ordnnar.ee.
Ordinance.

An ordinance providing for the re
funding of impounding tees in certain
caseo, and for other purposes.
Section 1. Be it and it is hereby
ordained by the mayor and council
oif the city of Brunswick, Ga. that
when the owner of any impounded
animal or animals shall show by pe
tition. supported by satisfactory ev
idence, that at the time the officer
seized such animal or animals they
were noit more than ten yards within
the territory where such animals are
prohibited from running at iarg*>
and that such owner was at
the time making effort in good faith
to take such animal or animals in
custody, or to drive them without
the limits of such prohibited terri
tory, it shall be with the discretion jf
the said mayor and council, to relieve
the owner from the payment of the
impounding fees imposed by the or
dinance of said city in such cases,
provided that such owner •will pay
into the city treasury the reasonable
cost and expense of feeding such ani
mal or animals during the time im
pounded, such cotst and expense to
be estimated and fixed by the marslia'
or assistant marshal; and provided
further that no such petition shall
be fentertained unless filed with the
clerk of council at least 24 hours be
fore the time fixed by the mar
shal for such animal oir animals to
be sold.
Sec. 2. Be it further ordained by
the authority aforesaid, that ail or
dinances and parts of ordinances in
conflfliet herewith be ami the same
are hereby repealed.

That the city attorney be directed
to take immediate steps to recover
the SBOO.OO arrears in rental on foot
of Prince street.
That a special committee bo ap
pointed by th mayor toi investigate
the status of the lease on fruit of
George, with a view of settlement.
The mayor appointed as the commit
tee Aldermen Dart, Cook and New
man.
That the committee on public works
be authorized to purchase enough
shells to complete the work in hand.
That $2.50 to be paid to E. Bowen,
of the public department, for special
rervijees rendered in the sanitary
department.
