The cas'e was that of R .E. Hunter. The matter before the Bourt was tho j>ctition of the trustee to sell the assets of the estate. The Brunswick Bank & Trust Company, through Its attorneys, Kay, Be cue t & Conyers, op posed the petition, objecting to the sale of the property free and clear of liens. The bank holds a Mortgage os the stock of goods forming a part of the estate and they insisted that as ithore was a mortgage on this property the court, should order the property sold subject to, and not free from, the lien of the mortgage. They further contended that the bankrupt court had no jurisdiction to order a male of the property free and clear of lien under the circumstances. D. W. Krauss represented the cred itors and C. L. Sheperd, the trustee, appeared far himself. The referee hold that, the bankruptcy court had jurisdiction to sell the property free and clear of ail incumbrances and or dered the trustee to advertise the prop erty for sale. The bank may appeal from the decision f the referee and if this Is not don* the property will be sold in about ten days. The referee will hear the M. M. llit on case from Charlton county, the J. H. Coibb case from Coffee county , and the petition of the trustee for leave to sell certain assets in the case of A. H Baker, from Ulis county, to morrow morning. Getting Their Boats Ready.
