KEF.P THE BACK YARD CLEAN
BALANCE OF SUMMER,
While the health - conditions in
Brunswick this summer have been
far better than last year, still condi
tions must not be perfect even now
as already several castes of l’ev< r have
i recently developed in various sect
ions of the city. This may be due to
the incessant rains of the past month
and consequent ii'.at|nant', water in
yow places upon vacant lots or in
excavations for buildings.
The people of the city generally
should assist the sanitary department
of the city in Its efforts to keep Ilia
town clean. Don't let stagnant water
stand in your back yard. It not only
creates hundreds of mosquitos, but
also causes sickness.

AN IMPORTANT DECISION
No Fault of Vessels When Men Who
are Only Employes of Charters
of Vessels are Killed or
Injured.
Judge Emory' Speer has rendered a
decision in the admiralty case of Nan
ey Williams, colored, against the Eng
lish steamship Loglands, that is of
considerable import to ship intersts
as well as stevedres.
The point decided is a lew one. it
is that neither the ship, nor the ves
sel's owners is liable for any injury
suffered by a person, not a servant of
the vessel. Till at is that the ship is
not liable to the stevedores for neg
ligence on he part of fellow labo -
ers or any one else engaged in the
work that caused the injury.
The ruling was filed in the office of
the clerk of the federal cqurt in Sav
annah Tuesday. It is in the suit of
Nancy Williams, of that, city, for the
death of her husband. Leander W'ill
'•’’u.s. Tide petition was filed last
.‘-.im-nilier and SIO,OOO was the amount
sought to be recovered. The petitiou
charged that Williams lost ills life
through the negligent dropping of a
beam in one of the discharge holds
in which Williams was at work.
The case was argued before Judge
Speer, the defense, contending that
tlberc was :io liability resting upon the
ship for the fatality. It was suggested
by counsel, and the court gave leave,
that an amendment bo filed directing
the suit against tlie owners of the
ship, instead of the ship itself. Mr.
Lcaken representing the ship owners,
took the .position that suo’i an amend
ment; was not good in law and cited
his authorities, Illie ease was consid
ered on this point and the decision
of Judge Speer is that the proposed
amendment lie denied, and the origi
nal libel be dismissed .
This ruling settles two important
points in this jurisdiction, that I boro
can be no recovery for any man who
is killed on a vessel who is not an
employe ol the vessel; that, the ship
is not liable to the stevedores for au.v
negligence on the part of fellow em
ployes, such as was the case in this
instance.
Williams was nn employe of Iho
stevedores, and was In Hie hold of
the vessel. A fellow employe stood
on the main hatch and signaled to
the “donkey” engineer when to lift
and lower the freight. It was claimed
by Williams’ representatives tlhat the
winchman failed to do his duty. The
declaration of the petitioner showed
that the stevedores were simply em
ployes of the characters of the vnq-.
sei and not employed by the ship-.
The principal point is that, the death
of a fellow workmen Is not charge
able to trie employer Inis prevailed,
and in admiralty it is a decision that
a suit in rent cannot be amended and
made a suit against the owners per
sonally.
