When a horsa is so overworked n
lies down and in other ways declares
its inability to go further, you wom-i
consider it criminal to use force.
Many a man of humane impulses
who would not willingly harm a kit
ten. is guilty of cruelty where his own
stomach is concerned. Overdriven,
overworked, when what it needs is
something that will digest the fooa
eaten and help the stomach to recu
perate. Something like Kodol For Dys

THIS NEGRO GOT
THREE SENTENCES
JUDGE FORGOT TO ASK HIM IF
HE HAD ANYTHING TO
SAY.
Washington, Nov. 13. —Twleo Fr!
ilay the death penalty was pro
nounced on William Burge, the ne
gro wife murderer, making the third
time he had been sentenced to pay
the penalty of his crime on the gal
lows. The necessity for the impost'
tion of the sentence a third time
was because of the inadvertent fail
ure of the court to ask the prisoner
the usual question: “Have you any'
thing to say why the sentence of
the law should not be imposed on
you?”
As if anticipating the horrible
death which awaits him, when first
called into court for sentence, Burge
appeared with a noose mode of two
handkerchiefs tied around 1113 neck
Tho court pronounced the death
sentence on Burge, naming Tuesday.
December 4. between the hours of
12 noon and 2 p. m . as the time of
jixts execution.
A few minutes later the rumor
that Burge would have to be resen
tenced was circulated rapidly about
the city hall, and afte. a brief con
sultation with counsel, judge Gould,
who had left the bench, directed
court to bo reconvened and Burge
was again brought Into the conn
room.
Justice Gould ordered Burge to
stand up. and asked If he had any
thing to say, why sentence should
not be imposed
Burge broke out In a very inco
herent harrangue in which he said.
“Judge Gould, you are a nice man,
and 1 expect to see you In Heaven
My wife is supposed to be a dea,! I
woman, but I don’t know it. I am
act a sane man. If anybody on
earth is insane, I am.”
Apparently becoming exhausted
by his effort, Burge "threw a fit,"
similar to those he suffered during
his trial.
Burge was convicted of tho murder
of his wife, Nettie Burge, January
27, 1903. He was tried before
Justice Wright and was sentenced
Y him to he hauged November 10
1905.
