Whether or not the election will

be that the county attorney will n

THE BRUNSWICK DA.LY NEWS SUNDAY, MAY 5, 1907.
COMES MUST
ALL BEJAREFUL
IN THE MATTER OF DELIVERING
INTOXICANTS TO
MINORS.
Transportaton companies will have
exteedingly careful in the mat
ter of delivering intoxicating liquor,
to min ;rs, according to a decision
rendered by the state court of ap
peals in the case of the Southern
i-.Xi-ross Company v the from
Gordon superior court.
Although the court granted Che ex
press company anew trial in the case
reversing the decision under widen
it was found guilty and fined, on 'the
ground that there was no evidence
to show that the agent made the
delivery or permitted it to be made
in this particular case, it held that
a corporation is amenable to the
criminal law which prohibits any
one from furnishing or delivering
intoxicating liquors to minors.
ihe court holds that the respou
sibllty of corporations for violating
ihe penal law is well settled, and
thatv the corporation can be held
guilty of furnishing liquor to monors,
delivery to a minor is made h.. .
at out, even though the corporation
r--let-takes to do no more than tran
sit the liquor to lts destination.
The only reason upon which t:•
court ot appeals reversed the decis
ion in the case was that the evi
l nice failed to show that the and
ery had been made n.
agent at Calhoun, or had been p
mlttei by him.
