NOTICE of ELECTION BRUNSWICK, Ga„ Aug. 24, 190S. Notice of election to be held in the city of Brunswick, Georgia, on the 26th day of September. 1908, to determine the question of authorizing the mayor and council of the city of Brunswick. Georgia, to enter into a contract with the Mutual Light and Water company for the furnishing of water, gas and electricity to said city. To the Qualified Voters of the City of Brunswick. Georgia: You are hereby notified that an •election will be held in and for said city of Brunswick, on the 26th day of September. 190S. to determine the question as to whether or not the mayor and council of said city shall enter into a contract with the Mutual Light and Water company, a corpora tion with its principal office and place of business in said city by the terms of which said mayor and coun cil shall take from said Light and Water company, and said company shall furnish to said city, water, gas and electricity for municipal purples for a term of ten years from Octfber Ist, 1908, in quantities and for as follows, te-wit: Water for 93 hydrants for fire pur poses $39.75 each per annum Water for 13 fountains for drink ing purposes . .$25 each per annum 138 street gas lamps for light ing purposes ..$lB each per annum 55 arc electric lights of 450 Watts capacity for lighting streets of said city $73 each per annum All of such amounts and indebted ness to be paid as follows: The amount to be paid annually for water, gas and electricity is to be di vided into twelve equal amounts, and such amounts are to be paid by said mayor and council to said Light and Water company monthly on the 20th day of the month subsequent to the month in which the service is render ed and in which the hills accrue, and which will make such monthly pay ments as follows: Water for fire hydrants and fountains $333.14 7-12 ■Electricity for street light ing purposes 343.75 Gas for street lighting pur poses 207.00 Making the total amount to he paid monthly $885.89 7-12, and making the total amount to be paid by said mayor and council to said company each year during the term of said ten-year contract $10,630.75, and making the total amount to be paid by said mayor and council during said entire term of ten years, $106,307.50. All of said indebtedness to he paid off and discharged within ten years from the 20th day of November, 1908. Said election will be held at the city hall in said city in the same manner and under the same rules and reg ulations as provided by law for the election of mayor and aldermen for said city, and as provided hv law for the election to he so held. The form of the balk t to be used in said election shall be as follows: “Authorized ballot to he held at election called aid ordered by the mayor and council of the city of Brunswick. Georgia, to be held September 20th, 1908. to deter mine whether said municipal cor poration shall incur an indebted ness for water, gas and electricity as set out in proposed contract, with the Mutual Light and Water company, to be in force for a per iod of ten years from October 1. 1908." (Each voter desiring to vote for •the incurring of such indebtedness must, strike the word “against,” as to each item for which he de sires to vote, and t.he voter desir ing to vote against, the incurring of such indebtedness must strike the word “for." as to eaoh item against which he desires to vote. The words following the word "for,’’ or the word “against ’ may, of course, be stricken by the vo ter, according as he may desire to vote.) FOR WATER CONTRACT FOR GAS CONTRACT FOR ELECTRICITY CONTRACT AGAINST WATER CONTRACT AGAINST GAS CONTRACT AGAINST ELECTRICITY CON TRACT. Election, September 26th, 1908. Manager.” The terms of said proposed con tract are as follows: STATE OF GEORGIA, COUNTY OF GLYNN. This Agreement made mnd entered into on this the 22d dajlof August, Nineteen Hundred and T*ht 11208). by and between the may® and coun cil of the city of BrunswV, | Georgia, •a municipal corporation edited and existing under the laws orsaid state, hereinafter for convenience styled and referred to as “The City,” and Mutual Light and Water company, a t rporatien existing under the laws cf said state with its principal office in said city, hereinafter for conven ience referred to and styled “The Company.” WITNESSETH: Ist. That the city agrees to consume and use and the company agrees to furnish water, gas and electricity for the term of ten years from the Ist day of October, 190S. in the quantities and at the rates and charges herein next below set out and specified, to-wit: RATES FOR WATER PER ANNUM. Water for ninety-thre.e hydrants for fire purposes $39.73 each The company will make the same rate for fire hydrants up to one hundred, aud if more than one hundred hydrants are desired by the city during said ten year period, the company will install the same (not less than one hy drant to be installed for every 430 feet of additional mains re quired to he laid) and the city shall pay for such hydrants in excess of one hundred . .$37.50 each Thirteen fountains for drinking purposes $25.00 each Additional fountains for drinking purposes at same rate. The company also agrees to give and furnish free to the city during term of this contract water as for lows: For two drinking Contains: for city jail: for fire department, and the city hall. Also 10.008,000 gallons of water per annum for flushing the sewers and sprinkling the streets. RATES FOR GAS TER ANNUM. 138 street gas lamps per annum. RATES FOR ELECTRICITY PER ANNUM. 35 arc electric lights of 430 watts capacity, per annum, . .$75.00 each If the city should desire, during the term of the contract, more than fifty five (35) arc electric lights the com nany agrees to install the same and the city agrees to pay the following rates and charges therefore: For each arc light of 450 watts capacity in excess of fifty-five (35) and up to seventy-five § (75), per annum, s7s.ooeach For each arc light of 450 watts capacity in excess of seventy five (75) and up to one hun dred and fifty (150), per an num $70.00 each For arc lights of 450 watts ca pacity. in excess of 150, per annum $65.00 each All additional arc lighls and addi tional street, gas lamps shall he, lo cated as designated by the city. The type of arc lights now installed and in use by said city are hereby ap proved. and it shall not be permissi ble for the company at, any time dur ing this eonlract, to use antiquated or out-of-date arc lights. All gas lights and all of such arc lights to be kept lighted each and every night from dark to and until broad daylight. If at any time during the term of the contract the city should desire to substitute Incandescent electric lights for the present street gas lamps in use by the said city, the company agrees to Install the same with rea sonable promptness and furnish the same to the city for the following rates and charges: Each fifty candle power lamp per annum $29.40 Each thirty-two candle-power lamp per annum $18.60 Tf lamps of other power should he desired by the city the company will install and furnish the same for pro portionate charges and rates based on the rates named for fifty and thirty two candle-power lamps: provided that in the event of such substitution the city shall take of such incandes cent lamps for street lighting pur poses. not less than the total number of stroet, gas lamps now in use. Tn the event of such substitution the company agrees to keep such lamps lighted as is agreed in re speet to are and street gas lamps. The city agrees to pay the company for such water, gas and electricity monthly, on the 20th day of each month subsequent to the month for which the service is rendered dur ing the term of this contract. Amounts not paid by such date shall bear in terest at the rate of seven per centum (7 per cent.) per annum from such date. The city shall at all times have Tie right, to require tests to ho made of the voltage of the electric cur rent. In the operation of its water plant, ’he companv shall at all times main tain a minimum domestic pressure which shall he sufficient to provide a free flow of water on the third floor of the hospital building as now lo cated in said city, and in case of fire shall maintain not less than sixty pounds minimum pressure, except n cases of unusual and extended con flagrations. The company shall have the right, to close any of the water mains during fires if in its judgment necessity arises therefore. The city agrees to pass and en force an ordinance preventing the flow of water when not in actual use, and also agrees In case of fires to en force existing ordinances regulating the use and flow of yard sprinklers and fountains, and other continuous flow of water during fires, and also existing ordinances regulating the use of yard sprinklers and fountains. The company agrees to equip all (street gas lamps with burners eon jfsuming not less than six cubic feet of gas per hour. THE BRUNSWICK DAILY NEWS, TUESDAY, SEPTEMBER 1, 1908. 2nd. In consideration of the agree ment of the city to take such water, gas and electricity, and to pay for the same at the rates and charges above set out, the company hereby agrees to furnish and supply to the inhabitants of said city during the term of this contract, water, gas and electricity and also agrees to furnish to the city for municipal purposes, water, gas and electricity (in addition to what is specified for the city) for rates and charges which shall not exceed the following sums for the services stated, to-wit: RATES FOR WATER PER ANNUM. Schedule No. 1. Rates for Dwellings Containing Not Mere Than Three Rooms. Single spigot for household u5e..55.00 Water closet in addition $2.50 (Additional openings as per Schedule No. 3.) Schedule No. 2. Rates for Dwellings Containing Four Rooms. Single spigot for hosehold uses only $6.00 Water closet in addition $3.00 (Additional openings as per Schedule No. 3.) Schedule No. 3. Rates to Consumers Occupying Dwellings Containing More Than Four Rooms. Single spigot on premises for household use only (plain bibb) $7.20 Bath tub. same premises in addi tion (plain bibb) each 3.60 Additional spigot same premises (plain bibb) each 1.80 Water closet, each 3.60 Additicnal water closet, same premises, each 2.70 Urinal in addition, same prem ises, each 1.80 Stationary washstand in addition, same premises, each 1.80 Yard hose bibb for sprinkling pur poses in addition to household spigot, oach 5.40 Miscellaneous Schedule. Yard sprinklers to ho used with not more than 50 ft. hose and 1-4 inch nozzle between hours of 4 p. tn. and 9 p. in. of any day, but under no circumstances during time of fire. A maximum rate of $25.00 per an num will bo charged consumers oc cupying single dwellings (hoarding houses excepted), provided, however, extra charges will lie made for yard fountains or for any service not pro vided for in tfie foregoing schedules. Nothing herein contained shqll be construed to authorize the company to charge any consumer now paying $25.00 per year any greater amount for present service. Yard or st root hose bibb to he used exclusively for sprink ling and outside cleaning pur poses. frr stores to lie used not exceeding four hours per day and to lay dust and cleaning purposes $12.00 Rates for boarding houses shall be 50 per cent, above the rates pre scribed in Schedule No. 3. Parties who have pumps or private wells desiring water from the com pany, will be charged the rates as prescribed in Schedule one (1), two (2) and three (3), respectively, pro vided that where only one opening or service is desired, the rate shall he seven dollars and twenty cents ($7.20), and provided further that not more than four dollars ($4.00) per annum shall he charged for water closet where no other water is taken on the premises. OFFICES. Special contract rates will he made i according to circumstance and serv- j ice, in no case to exceed the maximum . rates prescribed in Schedule No. 3. STORES. 1 Rates for stores other than specified shall he as prescribed in Schedule No. 3. MAXIMUM METER RATES PER 1,000 GALLONS. 250 to 500 gallons daily @ 20c per 1,000 gallons. 500 to 1,000 gallons daily @ 18c per 1,000 gallons. 1,000 to 5,000 gallons daily @ 16c per 1,000 gallons. 5,000 to 10,000 gallons daily @ 14c per 1,000 gallons. 10,000 to 15,000 gallons daily @ 12c per 1,000 gallons. Over 15,000 gallons daily—special rates. Thr company shall have a right on meter rates to charge such consumer a minimum of one dollar and fifty cents ($1.50) per month. It being understood that such minimum charge applies only where consumer does not use one dollar and fifty cents ($1.50) worth of water per month. Consumers shall furnish and install their own meters. The daily consumptk n of water to he fixed by averaging meter reading at end of each month or quarter (wheth er readings shall be monthly or quar terly to be at option of company). The company shall have the right to require from each consumer an advance deposit (for the month cr quarter according to the plan of read ing meters which may be adopted by the company) not to exceed, a suffi cient amount to cover the minimum quantity of consumption provided in this Schedule for maximum rates. RATES rOR ELECTRICITY FOR LIGHTING PURPOSES. The rates for electricity for lighting purposes shall be eleven cents (lie) j per one thousand watts, provided that discounts on consumption exceeding five ($5.00) dollars per month shall be allowed as follows: $ 5.01 to SIO.OO- — 5 per cent. | 10.01 to 20.00 7 per cent. 20.01 to 40.00—10 per cent. 40.00 to 60.00 —12 per cent. 60. ex and upwards—ls per cent. Electric lights shall be furnished to consumers at any point within the highland boundaries of said city upon the terms herein stated: provided the second party shall not be required to make any extension as much as eigh teen hundred (1.800) feet from any electric line existing at the time the application therefo-e is made un less the total revenue to lie produced by said extension from any and all consumers using the same for lighting purposes, shall he not less than four dollars ($4.00) per month at the rates herein prescribed', or unless such con sumers will enter into a contract to pay for such service not less than four ($4.00) dollars per month in the event the electricity consumed o''l not produce a revenue cf four dollars ($4.00) per month under such pre scribed rates. Extensions in excess of eighteen hundred (i,800) feet shall tie made on the same proportionate basis. The company shall furnish electric meters to consumers of electricity (ex cept that it shall not he required to substitute meters for the meters now owned and installed by ct nsnmers un til such meters become so defective as to lie unfit, for service) and the sec ond party shall be entitled to collect a minimum charge of one dollar ($1.00) per month from all consumers to whom such meters shall lie fur nished, such minimum charge to ap ply if the consumer fails to con sume one dollar’s worth of electricity per month. The company shall have the right to charge oach consumer who owns and has now installed his own meter a minimum of fifty cents (50c) per month. Tile company, nr any consumer, shall have the right to require me ters to be tested from time to time as lo accuracy. RATES FOR ELECTRICITY FOR POWER PURPOSES. The rates for electricity for power purposes shall he seven and one half cents (7 1-2) per one thousand (1,000) watts, except for operating fans, or for operating motors cf one horse power or less, for which the rates shall he t.he same as lighting rates with same discounts allowed on the light ing rates. The same provision as to meters shall apply to consumers of electric ity for power purposes as above pro vided for consumers of electricity for lighting purposes. RATES FOR GAS. The rates for gas to the city (other than as above provided for street purposes) and to private consumers, for lighting purposes, shall he one dollar and fifty cents ($1.50) per one thousand (1,000) cubic feet, and for hi ating and cooking purposes the rate shall he one dollar and twenty five cents ($1.25) per one thousand (1,000) cubic feet. The company shall furnish gas meters to consumers and shall be entitled to collect frem all consumers to whom such meters shall be furnish ed a minimum charge of fifty cents (50c) per month, it being understood that such minimum charge applies only when consumers shall not use fifty cents (50c) worth of gas per month. 3d. It is agreed that the rates and charges herein set out and prescrib ed to consumers shall be effective as of the Ist day cf July, 1908, and the company herein- agrees to rebate to consumers whatever amount will he due and owing to them by reason of the reduction in rates herein made in accordance with the agreement to make such rate effective on said first day of July. 4th. The company further agrees that should the population of said city Increase during the term of this con tract to twenty-five thousand (25,000) bona fide residents, it will re duce the rates to all consumers of electricity, other than the city, from eleven cents (11c) per thousand watts to ten cents (10c) per thousand watts, with the same provision for discounts to consumers of electricity as provid ed and set out in this contract. Such reduction shall be effective beginning with the month immediately succeed ing the month in which it has been ascertained that such population has so increased to twenty-five thousand (25.000). sth. t is further agreed by the com pany. in consideration of the making and execution of this contract for the taking of water, gas and electricity by the city, that it does hereby give and grant to the city an option to purchase and acquire the waterworks plant and appurtenances of the company as lo caed and constructed in said city at the expiration of the first five year period of the term of this contract, or at the expiration of said ten-year period, and which plant and appur tenances shall also include the follow ing real estate in said city, to wit: New Town Lot Number Two Thou sand and Ninety-four (2094) and that portion of Old Town Lot Fifty-one (51) described as follows: Beginning at the intersection of the East line of Ogle thorpe street with the Southern line of F street and running thence south along the East line of Oglethorpe street to the North wall of the pres ent electric power-house of said com pany (and which wall shall be a party wall); thence running East along the North wall of said power house and on a line extending beyond it to the Western lino of Grant street, being a total distance from the East, line of Oglethorpe street to the Western line of Grant street of one hundred and eighty (ISO) feet; thence running North along the Western line of Grant street to the South line of F street: thence running Westerly along the South line of F stroet one hundred and eighty (180) feet to the point of beginning. The value of said ♦water works plant and appurtenances, in cluding said real estate, to lie deter mined by arbitration, the city to se lect one arbitrator and the company | to select one, and if said arbitrators , fail to agree on such valuation, they I shall select an umpire, and the decis | ion of such umpire as to such valu- I ation shall be final and binding on the parties hereto. If the city should desire to exercise this option, it must give notice of its intention six (6) months prior (o the expiration cf the first five (5) year period, or six months prior lo the expiration of the ten (10) year period, as the case may he, such notice to he by formal resolu tion cr ordinance, copy of which must he served upon the president, vice president, or manager of the com pany. Such valuation or appraisment must he made and submitted to each party hereto within two (2) months from the date of the service of such notice, both parties agreeing to promptly select their arbitrators af ter the service of such notice. In the event *f such purchase, the city shall pay in cash to the company the amount, "so determined as the value of such water plant at the expiration of said five (5) year period or sa'd ten (10) year period, according as the city may elect to purchase at the expira tion of said five (5) year or ten (10) year period, or if the city should not desire to pay cash for such property, then the terms and conditions of pay ment niav be mutually agreed upon. ,In giving notice of its desire to pur chase, the city must state whether or net it desires to pay cash, and if not, then it. must set oat the terms and conditions upon which it desires to purchase. If the city, after giving such notice, should fall to make purchase and payment for said water works plant and appurtenances, as herein provided, (lien the city shall pay the entire expense incurred by the com pany in connection with such arbitra tion, as well as the expense of the umpire and its own expenses. In as certaining the value cf such water works and appurtenances, such arbitrarars or appraisers shall con sider and appraise the physical value cf all of such waterworks properties and appurtenances at the time of arbitra tion, without taking into consideration any franchise or commercial value. In the event of such purchase by the city, the company agrees that it will convey and deliver all of said water works plant and appurtenances free from liens, mortgages, bonds and any and all other encumbrances and in debtedness of every kind and eharac ter whatsoever. In the event of pur chase of such water-works plant at the expiration of the first five )5) year period, this contract in respect to the furnishing of water shall termi nate, but shall continue and remain of force in respect to gas and elec tricity both to the city and its inhabi tants until the expiration of said ten (10) year period. It is further understood and agreed that in the event the said city shall by ordinance, resolution, or otherwise, reduce or undertake to reduce, the rates herein prescribed and agreed upon for watr, gas and electricity to said corporation for municipal pur poses, or to the inhabitants thereof, or to other private consumers, before the exercise of the option herein given to said city to purchase said water-works plant and appurt nances; or shall, before said time, fail or re fuse to take and purchase from the company all the water, gas and el°c tricity needed and required by it fer the lighting of its streets, squares, lanes and alleys, public buildings, or I other municipal purposes, at the rates herein prescribed and provided for, then the option hereby given to th< city to purchase such water-work* plant and appurtenances shall be thereby revoked and annulled, and the city shall in such event lose all its rights in and to such option. 6th. It is understood that F. D. M. Stractian is a shareholder tn the com pany and that the said Straehan agrees if this contract upon the part of the city to take such water, gas aud electricity is authorized by vote of the people a3 herein provided, that he w r ill proceed with the construction of an electric street railway line in said city as provided in that certain ordinance passed and adopted by said mayor and 5 council on said July 3d, 1907, granting unto said F. D. M. Stra chan, his associates, successors and assigns, a franchise and privilege to construct and operate an electric street railway system, electric light plants and gas plants in said city, and that he will have not less than four miles of such railway eonslructed and in operation within twelve (12) months from the date of such elec tion. It is, therefore, agreed by the city that it will amend such ordi nance so passed on July 3d, 1907, so as to provide said F. D. M. Straehan, his associates, successors and assigns, shall have twelve (12) months from electric railway on lines constructed and have in operation not less than four miles of such electric railway, and the city also agrees to further amend such ordinance so as to per mit an additional five cents (sc) charge for passenger fares over the electric railwa on lines constructed on marsh lands, making the fare ton cents (lOe) for continuous pas sage on sin h lines having terminus on the marsh or waterfront on same. 7th. It is further agreed that if the sa:d F. D. Ml Straehan, his associates, successors and assigns, should fail to construct, and put in operation four (4) miles of such electric street rail way in said city, as provided in said original franchise ordinance so pass ed on July 3u. 1907, as the same shall lie amended as provided in paragraph No. 6 next above, then this contract shall terminate and end. Bth. It. is further agreed that when this contract shall have been author ized by vote of the people as pro vided ill paragraph 9 next below, a formal contract shall he entered into by and between the city and the com pany in accordance with the provis ions of this agreement. 9th. It is further agreed that this contract in so far as it involves an obligation upon the city to take from the company water, gas and electric ity, as herein provided, shall he promptly submitted for authorization to a vote of the qualified' voters of said city, as provided by law for the incurring of debts by municipalities, and in the event the result of such election is in favor of the authoriza tion rf the contract In respect to each and all of sucil items, to-wit, water, gas and electricity, then the san e shall be effective for a term of ten (10) years from and after the Ist day of October, 1908. 10th. This agreement is based upon the condition that the vote at the elec tion to be so held, shall authorize the city to enter into Ibis contract and incur the indebtedness herein set out as to each and all of the items named, to wit: water, gas and electricity, for the purpose and in the quantities herein stated. If the result of said election should be against the making of the contract and the incurring of the debt as to any one of said items then neither the company nor the city shall be found by this agreement or he bound or required to execute or per form the formal contract to he so executed after such election is held, and as her: in provided. IN TESTIMONY WHEREOF the said mayor and council of the city of Brunswick, Georgia, has caused this agreement to be executed in its cor porate name and behalf by its mayor, and the same to he attested under its corporate seal by its clerk, and un der and by virtue of a resolution pass ed and adopted in regular council meeting assembled on the 22d day of August, 1908, and the said Mutual Light and Water company has like wise caused these presents to he exe cuted on its behalf by its president, and the same to bp attested under its corporate seal by its secretary under and by virtue of a resolution passed and adopted by its directors in meet ing assembled on the 22d day of Aug ust, 1908, these presents being execu ted in duplicate. j MAYOR AND COUNCIL OF THE CITY OF BRUNSWICK, GA By R, R.
