Appointment of Harlan Fiske
Stone as Attorney General of
United States.
Washington, April 8 UP )—Trial
ol' alleged interference with pro¬
hibition continues to trace an in¬
tricate pattern of the wide ter
riton being covered by the sen¬
ate Daugherty investigating com¬
mittee.
In the meantime the senate
stopped to confirm the nomina¬
tion of Harlan Eiske Stone, of
New York, as attorney general.
Ifrice Armstrong, who testified
yesterday regarding eight brew¬
eries being under protection in
Chicago, was ordered to appear
again.
Armstrong, who testified at
length yesterday, took the stand
again today. One complaint was
that the “Western brewery case”
was nolle pressed on orders from
the department of justice at
Washington although local inves¬
tigators thought the case should
be presented.
It was stated at the time by
the secretary of the brewery
company that five thousand dol¬
lars was offered lor settlement
by the company and was accept¬
ed by the government. Witness
told of failure to prosecute the
Garden City case and of efforts
to remove him because he would
not stop buying liquor in saloons
they did not want prosecuted. Mr.
Armstrong said he reported be¬
tween a thousand and fifteen liu.i
dred cases hut not until six
months ago a witness was never
called in a commercial case. In
most cases where trials were
finally had most of these result¬
ed in small lines.

A I iOl’.M-A GENERAL NAPIER
\ S INSPECTION TAG DOES
NOT COMPEL ADMITTANCE
--—
Atl-mta, April 8 (/Pi—At the
quest of the state board ol entomolo
gy, Attorney General George M. Na
pier has ruled lh:it the state has
right to bar the importation of
and nursery stock regardless of
whether or not the plants in question
bear f ho inspection tag of the
oral horticultural board.
The attorney general ruled that the
inspection tag does not compel the
state to admit the plans without in
spcction by the state board of on
tomology or its agents.
1 be board ot entomology sought
tbs attorney generals ruling in its
efforts ot'prevent the bringing into
the state of plants from regions said
to be quarantined against the Jap
anose beetle and the Oriental peach
moth.
Ira T. Williams, state entomolo
gist, st Ted that il these ins,-,-', pests
were allowed to gain a foothold in
Georgia, they would prove a serious
menai-c to the peach, apple and otiier
if«R <'t-„ps.
The tittorney general held that the
fact that the federal government
inai-'t sins a horticultural hoard,
whose duties are to inspect all plants
shipped into this country and all
does not abrogate th sti te’s own po¬
powers in protecting its
turn! and horticultural interests, and
it is entirely within tie -state's
vince to requier state inspection of
all such imported plants, or to entire
ly quarantine certain
ateas, in addition to the federal
spin tion.
