We recommend that the office of clerk
of board of county commissioners lie es¬
tablished separate aud distinct from the
office of Ordinary of Mitchell County;
said clerk to be elected by a majority of
the Board. We further recommend
that provisions be made for the election
of another county commissioner to fill
the place made vacant by the Ordinary
who is now ex-officio a member of the
Board. We also recommend that the
compensation of the clerk of said Board
be fixed by said Board aud that his du¬
ties be to inspect the roads and bridges
of the county and to make report there¬
of to the Board at its regular sessions;
to attend regularly the meetings of said
Board and to perform all the duties or¬
dinarily incident to the position and
such other duties as may be prescribed
by said Board.
We, the grand jury, have adopted for
this county the alternative road law of
this state for this county, as contained
in article two of volume one of the code
of 1895 and the various acts of the legis
latute amending the same since the
adoption of said code and we recom¬
mend that the county commissioners of
this county proceed to put the same into
operation as soon as it is lawful and
practicable to do.
We recommend that the fence that
has been placed in the road at the old
Tinsley place belonging to D. B. B. Col¬
lins, be removed, so as not to obstruct
the public road.
And also that the fence he removed
from the public rood leading off from
the Old Hawthorne trail towards Baeou
ton on Miss Della Collin’s place.
Wo also recommend that Marshal
Shiver to appointed Notary Public for
the Algor district.
We note in the official gazette of
Mitchell county an advertisement of in¬
tention to apply for local legislation in
the form of a bill to amend the Act es¬
tablishing the City Court of Camilla so
as to provide that the judge and solici¬
tor of said court'be -elected by the quali¬
fied voters of said county.
Believing that such legislation would
be very much against the interests of the
county, aud that there is no demand for
the same, wo earnestly recommend that
no such hill be introduced or passed and
request our Representative and Senator
not to introduce such a hill and to vigo¬
rously oppose the same.
A BILL.
To be entitled an Act to prohibit the
sale of spiritous, vinious and malt li¬
quors, and intoxicating bitters and ciders
in the county of Mitchell, except as in
this act provided; to regulate and con¬
trol tiie sale thereof throngh the medium
of Dispensaries in each of the several in¬
corporated towns of said county; to e -
tabiish and perpetuate a Board of Com¬
missioners for such Dispensaries and to
prescribe their powers and duties; and
for other purposes.
/ SECTION FIRST.
Be it enacted by the General Assembly
of Georgia, and it is hereby enacted by
the authority of the same, that from and
after the passage of this Act it shall not
be lawful for any person to sell spiritu¬
ous, vinious and malt liquors and intoxi¬
cating bitters and ciders, in the county
of Mitchell except as provided for in this
Act; aud any person who may do so shall
be guilty of a misdemeanor and on con¬
viction shall be punished as prescribed
by Section 1039, Vol. HI of the Code of
Georgia of 1895. No Muncipal authority
of any city or town in said county shall
have authority to grant license or renew

SECTION SECOND.
Be it further enactedby the authority
aforesaid that the persons now holding
the position of Commissioners of Road
and Revenues of Mitchell and their suc¬
cessors to be elected shall be known as
Dispensary Commissioners in and for the
county of Mitchell and the same are

the purpose of establishing Dispensaries
in said county as aforesaid, for the sale
of spirituous, vinious or malt liquors and
intoxicating bitters and ciders.
SECTION THIRD.
Be it further enacted by the authority
aforesaid that, there shall be appointed
by tlie Dispensary Commissioners of
Mitchell county from among the citizens
of said county three upright persons to su¬
pervise each Dispensary who shall be
known as supervisors for said Dispensar¬
ies whose duties it shall be to establish
aud maintain in said towns at some suit¬
able and conveninent point, a dispensary
for the sale of spirituous, vinious, or malt
liquors or intoxiating bitters and ciders.
SECTION FOURTH.
The supervisors thus chosen shall hold
office for two years from the date
of their appointment and until their
successors are appointed and qualified.
Any vacancy occurring in said Board of
Supervisors shall he filled by the author¬
ity appointing them. Any of said su¬
pervisors may be removed from office by
the Dispensary Commissioners of Mitch¬
ell county at any time upon ten days writ¬
ten notice for any neglect of duty or any
other good cause shown. Said supervis¬
ors sir. 11 select one from their number

SECTION FIFTH.
Be it further enacted that the Treas¬
urer of the town, in which said Dispen¬
sary is established, shall he the Treasur¬
er of said Dispensary, and for his ser¬
vices as such Treasurer he shall receive
one-half of one per cent, of all moneys
handled by him arisiug from said Dis¬
pensary; provided, his salary shall not
exceed Seventy-five Dollars per annum,
; nd provided further, that no other com¬
mission shall be paid out of said money
for handling the same. Said Treasurer
shall give bond with good security in a
sum not to exceed Two Thousand (3.000)
Dollars payable to said Dispensary Com¬
missioners, conditioned for the faithful
accounting for all moneys that may
come into his hands each day as Treas¬
urer of said Dispensary aud for tlie faith¬
ful performance of all duties required of
him as such Treasurer, said bond to be
approved by said Dispensary Commis¬
sioners.
SECTION SIXTH.
Be it further enacted that said
Board of Supervisors shall elect a man
of good moral character and sober habits
as Dispensary Manager for such Dispen¬
sary. Said Dispensary Manager shall
hold his office for two years from the
date of his election and may be removed
from office by said Supervisors for ne¬
glect of duty or for any good cause shown.
In case of vacancies in the office of Dis¬
pensary Manager for any reason, said
Board of Supervisors shall elect his suc¬
cessor for the unexpired term. Such
Dispensary Manager shall be at all times
: ubject to the orders, rules and regula¬
tions of said Board of Supervisors aud
shall, before entering upon the discharge
of hi i duties give bond with good securi¬
ty in the sum of Two Thousand (2,(XX))
Dollars made payable to the Dispensary
Commissioners and approved by them
conditioned for the faithfully accounting
for all goods and moneys that may come
into his hands of such Dispensary Man¬
ager, and for the faithful performance of
all duties required of him; and he shall
take and subscribe an oath that he will
faithfully and honestly discharge the
duties of Dispensary Manager. He shall
receive such compensation as may be
fixed by said Board of Supervisors not to
exceed Seventy-Five (75) Dollars per
month including all necessary help hire,
but his compensation shall not in any
way depend upon the amount of his sales.
Should said Dispensary to suspended or
close for any reason whatever then the
contract with'said manager and for rent
of storehouse shall be null and void.
SECTION SEVENTH.
Be it further enacted that such Board
of Supervisors shall for and in the name
of the Dispensary Commissioners of said
County establish and maintain a Dispen¬
sary for the sale of such liquors as before
mentioned, selling the same for cash on¬
ly. Said Board of Supervisors shall di¬
rect aud control the purchase and sale of
such liquors. All funds arising from the
sale of said liquors or from any other
source connected with said Dispensaries
shall be deposited with tlie Treasurer of
said Dispensary. All debts incurred
from the establishing such Dispensary
; shall be paid out of the funds so de¬
posited upon the order of the Dispensary
j Manager, approved by a majority of said
1 Board of Supervisors. Such Dispensary
shall to maintained and operated from
the profits arising from the sale of such
liquors, provided, that to inaugurate said
Dispensary, and to purchase tlie first
stock therefor, said Supervisors shall to
authorized to borrow money or pledge
the credit of said Dispensary Commis¬
sioners of said county, but they cannot
bind the county of Mitchell, or town in
which said Dispensary is ran in any way.
Each Dispensary operated under this Act
shall to separate from the others, and in
no event shall the profits of one Dispen¬
sary be used to maintain another, hut
each must to self-sustaining, aud any
unproductive Dispensary shall be discon¬
tinued upon the order of the Supervisors
thereof, as soon as it appears that such
Dispensary is unproductive.. Said Board
of Supervisors, shall from time to time
make rales and regulations for the oper¬
ation of such Dispensaries, not in conflict
with this Act nor the laws of this state.
The quantity of such liquors sold to any
one person at any one time slialll not ex¬
ceed four gallons, aud in no event shall
such liquors be furnished in quantities
less than one-half pint; and none shall
be drank in the building or on the prem¬
ises, where such Dispensary is located.
Said Dispensary shall not be opened be¬
fore sunrise and shall be closed each day
at sunset, except during the winter sea¬
son it may be opened at six (6) o’clock a.
m. and closed at six (C) o’clock p. in.
Said Manager shall be bound by all the
laws of this state regulating tlie sale of
liquors, and all the regulations of the
Board of Supervisors not in conflict with
the laws of this state.
SECTION KIOllTB.
Be it furtlier enacted that tlie Dispen¬
sary Manager shall sell to no person any
of said liquors, except in sealed packages;
and whenever an original package is
broken it shall be at once bottled and
sealed in the presence of the said Super¬
visors or a majority of t’. am. Said Su¬
pervisors shall make a quarterly report
in duplicate, to the Dispensary Oonunis
sioner of Mitchell county and the Coun¬
cil of the town or city in which said Dis¬
pensary is located, showing the amount
of liquors bought, the amount of sales,
tlie expenses and the stock on hand at
thi! end of each quarter. Said Supervis¬
ors shall receive a salary of $25.00 (twen¬
ty-live dollars) per annum each, and in
no event shall any member of the Board
of Dipeusury Commissioners or the Coun¬
cil of the town or city in which said
Dispensary is located shall be elligible to
hold the office of Supervisor during the
term for which they have been elected.
SECTION NINTH.
Be it further enacted that tlie book of
account and all other papers connected
with said Dispensaries, shall be at all
times subject to the inspection of the
public. The Chairman of said Board of
Supervisors shall be under the special
duty of supervising said Dispensary, but
shall have no more power than any other
Supervisor. Said Supervisors shall take
and subscribe an oath that they will not
receive any gift, rebate, commission, or
other gain from any source connected
with said Dispensary, either directly or
indirectly, other than their salary.
SUCTION TENTH.
Be it further enacted that said Board
of Supervisors shall once in each quarter
set. aside as dividend or profit all moneys
belonging to said Dispensary that can be
taken from it without embarrassing the
continuance of said business with a stock
of such size as the Supervisors may deem
proper provided, that said Supervisors
shall have aright at all times to retain a
sufficient amount of the funds to enable
all bills incurred in tlie management of
said Dispensaries to be paid cash, and to
avail themselves of all discounts for cash
allowed on such bills. The money thus
set aside as profits shall to divided as
follows, to-wit:—‘’One-third of the same
shall be paid into the treasury of the
town or city in which said Dispensary is
located, and the other two-third shall be
turned over to the Commissioners of
Roads and Revenues of said County, and
shall by them be used for working the
public roads, or other public improve¬
ments of said County.
SECTION ELEVENTH.
Be it further enacted that all laws and
parts of laws in conflict with this act, be
and the same is hereby repealed.
We unanimously recommend that our
representative Georgia now in the General As¬
sembly of introduce law and have
passed a county dispensary with the
terms and conditions as set out in the
Bill presented by us.
