The Reading assuredly had ground
for complaint against the Philadel
phia shipper upon whose transporta
tion an embargo was laid. In normal
circumstances, no railroad refuses
money. Yet upon its own showing of
facts it is commanded by the Inter- .
state Commerce Commission to lift
that embargo if the shipments are in
terstate.
It must put all facilities that it af
fers to the fairest, promptest, most
favored patron of the line at the dis
posal of a shipper not only deemed
undesirable, not only negligent, but
by the evidence seemingly guilty of
obstructing the business of others.
The Reading officials were confi
dent of the justice of their course.
Men who sell shirts or building sites,
pig iron or parasols can withhold their
commodities from any would-be pur
chaser whose trade is not wanted.
The Reading officials are surprised to
learn that the power possessed by

flexible conditions.
The sole legitimate function of a
railroad corporation is to furnish
transportation, and it must exercise
that function without discrimination.
It has not the power to pick and
choose its shippers. The patron of a

railroad may be unfair, negligent and
generally undesirable as a purchaser
of transportation. But his shortcom
ings do not deprive him of the tights
possessed by every citizen. The
chance that injustice may follow in
isolated instances cannot be allowed
to imperil the principle upon which
the freedom and safety of commerce
depends. K
The reasoning in the report of the
commission. is unanswerable. Dis
crimination by a common carrier will
not and must not be allowed, however
justifiable it may seem, in any case.
For “if the exercise of such a power
were to be at all tolerated, carriers
would be able to issue sentence of
commercial death against some of
their patrons while continuing to
serve others.’
The creation and servant of the
people cannot constitute itself the
people’s master, dispensing “the
high and low justice” of finance and
trade at will.
Since a New York thief returned
a gold watch bearing the inscription,
“From Mother,” a good many men
are sorry that the inside of their
watch-cases contains nothing but the
photograph of some chorus girl.
“Learn straight,” is the
president’s advice to the youth of
the land, and he should have backed
that up with the caution not to aim
-in ’unloaded gun at anybody.
