THE Petition of Charles \V. Horn, Administra
tor of William L. Hampton, deceased, who
makes profert of letters of Administration, res
pectfully ehevveth, that heretofore to wit : On 11* “■
twenty-third day of October, Eighteen hundred
and fifty-one. John J. Harvard, then of Baker
county, and said State, now residing in the coun
tv of Thomas, and said State, purchased of one
Richard 11. Clark, Lots of land lying and being
in the City of Albany, and known and distin
guished in the plan of said city, as Lots numbers
fS3J fifty-three, [ss] fifty-five, and [s7] fifty
seven, on Commerce street, for which the said
Harvard, gave his two promisory notes, dated
23d October, Eighteen hundred and fifty-one,due
first November, 1851, the other due first Novem
ber, 1852, for three hundred and seventy-five dol -
tars each; upon which said notes at the request
of said John J. Harvard, your petitioners intes
tate, became bound as security. And for the ef
fectual securing, your petitioners intestate from
any and all liability as security of said notes, the
said John J. Harvard, on the twenty-fourth day
of October, 1850, made his deed of mortgage,
which mortgage has been duly recorded within
the time prescribed by the Statute, and is here i u
Court to be shown as well as said promissory
notes, conveying to your petioriers intestate Lots
fifty-three, fifty-five, and fifty-seven, on Com
merce street, in city of Albany, conditioned to be
void upon the payment by the said John J. ol
the two above described notes. But your peti
tioner avers that said John J. failed and refused
to pay the sum of money due upon said notes,
and that your petitioner as Administrator of
William L. Hampton, deceased, was bound am)
compelled,and did pay off and discharge said
notes, both principal and interest, w hich said
amount so paid nut, the said John J. refuses to
reluod to your petitioner.
Wherefore your petitioner prays that pitch rule
and order may he made and passed by the Court
according the Statute in such cases; rmde and
provided.

Upon hearing the ab ive and foregoing petition,
it is ordered by the Court, that the said defendant
do pav into the office of the Clerk of the Court,
on or before the first day of next Term, the sum
of seven hundred and fifty dollars, with all inter
est and cost of this proceeeding, or show cause,
on or before the next term of this Court, why his
equity of redemption iri and to said mortaged
premises should not he barred in terms of the
Law. It is further ordered, that tho service of
this Rule be perfected by publication in some
public Gazette in this Slate, or be served person
ally upon defendant, thirty days previous to next
term of said Court.

purpose of securing the payment of two promis
sory notes; one of which lor the sum of eleven
hundred and forty-one dollars and sixty-one rt-.,

of May next thereafter, is now due and unpaid.
It is ordered that the said Henry \V. Cowls,
do pay into this Court, by the first day of the next
Term, the principal, interest, and cost, due on
said note, or show cause (if any lie has) to the
contrary, or that foreclosure be he granted to the
said Joshua W. Hodges of said mortgage, and
tho eqtt ty of redemption of the said Henry VV.
Cowls, therein be forever barred; and that ser
vice of this Rule be perferted on said Henry VV.

IT appearing to the Court that the above Bill
‘*• was tiled, returnable to the November Term,
1852, of Baker Superior Court; and it further
appearing, that service of said Bill has not yet
been perfected on two of said Defendants, to vvit:
Williamson and Hardie; and it further appear
ing from the return of the Sheriff, that said De
fendants are not to be found in the county. It
is ordered that said Defendants, John 11. VViI
liamson and Robert Hardie, appear at the next
term of this court, and show cause why they
should not be compelled to answer the charges
of Complainants, as set forth in said Bill as
amended, and that service of this Bill, and
amended Bill, be perfected by publication of this
Rule, once a month for four months, next imme
diately after the adjournment of this term of the
Court, in one of the public. Gazetts of this State.

nys at Law, for John 1). Goneke, sheweth that
Solomon Graves late of said county, deceased,
did, while in life, execute to the said John D.
Goneke, his bond, conditionally to make titles in fee
simple, to a town lot of land in Cuthbert, in said
county, known in the plan of said Town, by No.
thirty-eight, (38,) being the south west corner of.
said lot, containing two acres more or less. That
said deceased failed to comply with his bond or
make any provisions therefor, that the purchase
money lias been paid, and praying this Court for
an order retail ring Louis A. Goneke Administra
tor cum annex/) teslamento, to show cause why
he should not make titles to said Town lot in ac
cordanee with the statute in such case made and
provided. Ordered that this Rule be published in
the “ Georgia Courier” for three month-, and at
three or more public places in said county, requi

Ceasar A^ Savage, i Rule Nisi to foreclose
Hubert O.'Kelley. Mortgage.
Present the Honorable William C. Perkins,
Judge of said Court.
¥ T appearing to the Court by the petition of Cea
sar A. Savage, that on the first day of Feb
ruary, 1853. Hubert O. Kelley made his two
certain instruments in writing, commonly called
promisory notes, bearing date the day and year
aforesaid, each for the sum of Two Hundred Dol
lars, both due on the first day of January next,
(after the date of said two notes) payable to Neil
McCoy or bearer, with interest from the 18th day
of January, 1853. And upon which said two
promisory notes, your petitioner at the instance
and pursuaion ol the said Kelley became secur
ity, and that afterwards to wit: on the first day of
February, 1853,the said Kelley, the better
to secure the payment of said two promisory
notes, and for, and in consideration of the sum
of Five dollars to said Kelley, by your petitioner
paid, and as well to save harmless your petition
er in his aforesaid security.ship, executed and de
livered to your petitioner his deed of Mortgage,
whereby the Faid Kelly conveyed to your petition
er two acres of land, situate, lying and being, in
the third District of Lee county, Known as the
Tan Yard, the same being upon the South West
corner of Thornhills place in said District, and
adjoining the lands of Daniel Woolbright. Two
liunikied hides arid leather mixed, one horse and
wagon, four cows and calves. Conditioned that
the said Hubert shall pay or cause to be paid,
siad two promisory notes, and save said Savage
harmless upon his security-hip, then the said
nates as well as said Mortgage Deed should be
null and void, and he ol no effect.
And it further appearing that the said notes
remain unpaid, and that Ceasar A. Savage hath
paid off the same according to the tenor and ef
fect ol said tvvo notes. It is therefore ordered that
the said Hubert O. Kelley, do pay into Court, by
the fir-t day of the next term thereof, the princi
pal, Interest and cost, due on said two promisory
notes, (or show cause to the contrary, if any he
has) and that in the failure of the said Hubert
O. Kelley so to do, the equity of redemption in
and to said Mortgage, premises be lorever there
after barred and foreclosed.
And it is further ordered that this Rule be pnr
lished in the Georgia Courier, orice a month ofr
four months, or a copy thereof served on the said
Hubert O. Kelley, or his special Agent or Attor
ney at least, three months previous to the next
term of said Court.

eulation than any attempt of the kind ever started in Amer
ica. It is filled with cuts and caricature Likenesses of per
sons and things, and these alone are worth the subscription
price, which is oniy One Dollar a yeaa, for wnich 52
numbers are mailed to any part of the United States.
The new volume commenced witeh the “Heminiscences
of John C- Calhoun, by.his Private Secretary.” and will be
cortiintiedin the Pick until finished, which will take nearly
a year to accomplish.
