“There was no conspiracy between Brett and Madison,” he said. “They
were not buddies.. .Brett Williams was deceived by Mr. Madison.”
Williams is no longer working as an attorney, but Litito said he hopes his
client can practice law again in the future. This will be up to the Georgia
State Bar Association.
Williams also offered brief remarks Tuesday and offered an apology to
Banks County, to the district attorney’s office and to his family. He said he
had learned an “profound and unforgettable lesson.”
“I am sorry for enabling this arrangement to occur by following a directive
by my head boss, the district attorney,” he said. “.I will never be involved
in anything like this again.”
During his sentencing, judge Robert Mallis said Williams was a victim.
“I am convinced that you were not aware of what Mr. Madison was doing
when he set up this arrangement with Banks County,” the judge said. “I
genuinely believe that you genuinely believed him. For a large extent, you
were a victim too. However, at some point, you should have known. But I
can understand being in that position.”
The theft scandal surrounding the DA’s office was uncovered by
The Jackson Herald newspaper in early 2007. A series of investigative sto
ries were published in March 2007 questioning Madison’s handling of DA
funds and his role in the Williams financial transactions.

largest department, got a 16 per
cent increase in projected spending
to $309,700, up from $266,900 in
2007.
Some $16,000 of that increase was
due to an expected hike in fine pay
ments to be passed along to the state
from the overall increase in city fine
income.
WATER/SEWER/
GARBAGE BUDGET
In the town’s water, sewer and
garbage budget, the town expects
to have $643,600 in income and
expenses. Most of the income and
expense are in the water depart
ment, which makes up $495,000 of
the total.

endum will be on the November ballot, Banks County chairman Gene Hart
said Monday. The BOC would not have to approve it.
The proposal is for four commissioners to be elected from districts but to
be voted on at large by all citizens of Banks County. The chairman would
be elected at-large and also voted on by all citizens.
Candidates seeking office from one of the four districts must live in the
district they run for. Candidates for the chairman’s position can live any
where in the county.
The issue of possibly changing from a three-member commission to a
five-member commission has been discussed for almost a year. First-term
commissioner Joe Barefoot has been pushing to allow citizens the opportu
nity to vote on the issue.

baseball and softball teams this
spring. That number is slightly
higher than last year, the director
said.
“It is one of the highest numbers
we’ve had,” Cronic said Monday
as he and his staff prepared for
Saturday’s events.
The recreation baseball and soft
ball season will continue through
May when All-Star teams will be

Public Hearing
The Banks County Board of Commissioners
will hold a public hearing on April 8, 2008 at
6:30 p.m. in the courtroom of the Banks
County Courthouse. The purpose of the
public hearing is to consider abandonment of
a portion of CR176/English Road from US
Hwy 441 to Historic Homer Hwy.
Pedestrian death on I-85 ruled accidental by authorities
The death of a 40-year-old pedes
trian on Interstate 85 Sunday evening
has been ruled an accident.
Kyle Anthony Waber, 40, was
struck and killed by a sport util
ity vehicle in the southbound lane
of Interstate 85 near the Maysville
Road interchange.
“It was an accident,” said Coroner
Keith Whitfield. “I heard street talk
saying he jumped off the railroad
bridge, but he ran across the road.”
Whitfield described Waber as “a
transient,” and said he was born in
California and had been in Carson
City, NV. He had no identification
on him at the time of his death and
was identified after his fingerprints
were sent to the Federal Bureau
of Investigation, according to a
Commerce Police Department inci
dent report.
Officers were looking for Waber
at the time of his death. They’d been
summoned to the Citgo convenience
store on Maysville Road at I-85 in

According to the police report, the
clerk said the “older white male”
may have been living in the woods
nearby.
Two city police officers searched
the woods and found a campsite.
The officer writing the report noted
that at about the time they found
the camp, they heard a strange noise
from nearby I-85.
The report noted that officers found
a pack of powdered doughnuts and a
still-steaming cup of coffee in the
campsite, but their search was inter
rupted when dispatch notified them
of a wreck on I-85.
At the accident scene, they found
that the pedestrian, who was dead,
matched the description of the “sus
picious person” they were seeking.
