A class action lawsuit may affect
your rights if you received an adver
tisement on your fax machine from
American Home Services, Inc.
TheTelephone ConsumerProtection
Act (47 U.S.C. § 227) prohibits send
ing unsolicited advertisements,
commonly called junk faxes, to fax
machines, A Fast Sign Company, Inc.
sued American Home Services, Inc.
a/k/a AHS alleging that AHS sent
hundreds of thousands of advertise
ments to fax machines throughout
metro Atlanta. The lawsuit is known
as A Fast Sign Company, Inc. v.
American Home Services, Inc., Civil
Action No. 2003CV-17276. The
court certified the lawsuit as a class
action.
In a class action, one or more
people or businesses sue on behalf
of others who have similar claims.
The court decided that A Fast Sign
Company can sue AHS on behalf
of all individuals and businesses to
which AHS caused its advertising
faxes to be sent.
AHS denies the allegations in the
lawsuit. The court has not decided
whether AHS did anything wrong.
That will be decided later. But your
legal rights are affected, and you
have a choice to make now:
•Do Nothing. By doing nothing,
you stay in the lawsuit and keep the
possibility of getting money or ben
efits that may come from a trial or
settlement. But you will give up any
rights to sue AHS separately about
the same legal claims in this lawsuit;
you will be bound by the outcome of
this lawsuit, regardless of the result.
•Ask to be excluded. Get out of the
lawsuit and get no benefits from it. If
you ask to be excluded and money or
benefits are later awarded at trial or
obtained through a settlement, you
won't share in those. But you will
keep any rights you may have to sue
AHS separately about the same legal
claims in this lawsuit.
To ask to be excluded from this
class, you must act before July 31,
2008.
There is no money available now,
and no guarantee that there will
be. Lawyers for the class must prove
the claims against AHS at a trial. If
money or benefits are obtained from
AHS as a result of a trial or settle
ment, you will be notified about how
to request and receive a share of the
judgment or settlement. We don't
know how long this will take.
