Truelove's home damaged twice by storms
Reece said he had lived on land
adjacent to a bogging hole in the
past and that it was really loud.
“Mr. Cline bought this land in
2001 and he knew the land was
zoned CAD,” Reece said. “A bog
ging hole nor anything close to it is
listed as a conditional use.”
John Bryan, Beaver Creek Drive,
said his property was trespassed
on when Cline was building a dam
across the creek.
“I asked Mr. Cline to remove
the dam and he agreed to do this,”
Bryan said. “I say that dam is ille
gal because he was trespassing on
my land.”
Bryan said he is also concerned
with alcohol being consumed on
the property and with people driv
ing on the roads while under the
influence.
“It is hard to see when you are
entering Brown Bridge Road and
people could get hit pulling out
into the road.” Bryan said, “I don’t
think any of ya’ll want this in your
backyard and we sure don’t.”
Sid Major, Sheila Mullins and
James Mitchell, all residents of
Beaver Creek Drive, voiced their
opposition to the facility as well.
Rick Bennett, Beaver Creek
Drive, asked the commissioners to
“please don’t take away my dream
house.”
Bennett said he could sit at
his house and see wildlife going
through his yard on any given day.
Bennett said this was his dream
house, however, he is concerned
with having to sell the house due
to his job location in Gainesville.
Banks County Planning Officer
Keith Covington said he has been
out to the property and he contact
ed the RCS about the dam and was
told there were no problems with
the dam because Cline was letting
the water run back into the creek
when the pond fills up.
“A conditional use permit is not
a conditional use,” Covington said.
“This does have a review period
and it has different requirements.
This is not a rezoning. This is a
conditional use permit and this is a
rarity in Banks County.”
Banks County Administrative
Assistant Angela Sheppard pre
sented the staff recommendation on
the application. Sheppard said the
conditions that needed to be added
are: 1) all vehicles on the site will
be rinsed off prior to entering the
roadway; 2) all vehicles that par
ticipate in the mud bogging event
will be pressure washed prior to
entering the roadway; 3) the water
from the mud bogging operation
should be controlled so no water
runs off into the roadway, onto
adjacent property or into the creek;
4) hours of operation should be 9
a.m. to 8 p.m.; 5) a 25-foot buffer
should be placed along the creek;
6) a 150-foot buffer should be
placed along the road; and 7) the
water will be provided by private
wells.
Commissioner Rickey Cain
made the motion to approve the
conditional use with the above
conditions and commissioner Joe
Barefoot said, “I will reluctantly
second this motion.”
OTHER BUSINESS
In other zoning business at
Tuesday’s meeting, the commis
sioners:
•tabled a request for a variance to
change property lines between two
lots on Sterling Drive in the Windy
Knoll Subdivision at the request of
property owner Bob Blackwell.
•voted to deny a request from
Larry G. and Bennie Jackson for
a conditional use for a trucking
business on 3.488 acres at 1806
Moccasin Gap Road, Lula. Jackson
said he wanted to downsize and
move from his current location
along Hwy. 365 in Lula. Jackson
said half of his trucks stay gone
out of town. “We do a lot of state
work,” Jackson said. The hours of
operation would be during day
light hours, Jackson said. Geralynn
Campbell, Arthur Cullipher and
William Bittler spoke in opposi
tion to the request during the pub
lic hearing. Those opposed were
concerned with the extra traffic on
the road, the noise, the air quality
and the effect the use would have
on surrounding property values.
Hart said, “I went out a looked at
this site. I am concerned with the
entrance.” Cain made a motion to
approve the request with a condi
tion that he leave a tree buffer
around the property. Barefoot said,
“I will not second that motion.
I have lived in that area and I
see some issues with safety.” Hart
broke the tie vote with a vote in
opposition to the request.

The home of Jerry and Marie
Truelove, Welborn Road, Maysville,
was damaged not once, but twice,
last week by acts of Mother Nature.
The Trueloves said on Thursday
around 5:30 p.m. they were going
out to get in their car when they
heard a loud noise, similar to that
of an explosion. Mr. Truelove said
he went back in the house to check
on their dog that is afraid of thunder
and lightning, and noticed a large
oak tree at the front of the house
had been struck by lightning. Mr.
Truelove said the only thunder they
had heard was off in the distance and
it was not raining at all.
Mr. Truelove said the tree that was
hit was over 100-feet tall and the
lightning strike blew all the bark off
the tree from the ground up about 15
feet. A piece of the bark apparently
flew into a window at the home and
shattered it.
The lightning knocked out the
couples’ TV service and their com
puter, Mrs. Truelove said.
Mrs. Truelove said late Friday
afternoon they returned home dur
ing a rainstorm to find that a portion
of the tree had broken and fallen on
the house and pierced the roof.
“Rain was coming in to the com
puter room by the bucket fulls,” Mrs.
Truelove said.
Mr. Truelove said he contact
ed Mauldin Tree Service and the
owner, who lives in Clarkesville,
came down Friday night and helped
family members cut a portion of
the tree off the house so they could
cover the roof with a tarp to keep
the rain out.
Mrs. Truelove said the tree service
owner advised them that he would
need to bring a crane in to lift the
rest of the tree off the house before
it can be cut up.
The Trueloves said they want peo
ple to be aware that you can have a
lightning strike without a storm.
