Thr Secretary of War has requested tho
Govoruor of Montuna Territory to pre
vent tho starting of the expedition from

arms, and a large amount of ammunition.
The Secretary urged that such an expedi
tion at this timo, would bring on a wur
with the Indians. Perhaps that was its

The story is, that tho friouds of a popular
minister, in some region of tho country

anniversary of his life. Tho plan was for
tho barrel to bo placed in the vestibule of
tho church, with tho hung out, and for
each man to bring u bottle of wino and
empty it in the barrel. It occurred to
some that if they should bruig wutor in
stead of wino and empty it in tho barrel,

NEW YORK CITY.
The Now York llerald, of the Dili iust.,
publishes a map of tho city as eularged by
the receut annexation of portions of West
chester oounty. Beforo this anuoxation,
Now York city was on island, enclosed
within the North or Hudson, tho Bast,
and tho Harlem rivers. Tlio territory an
nexed lies north nnd cnsl of the Harlem,
nud is iu uxtout nearly ns great ns tho is
land heretofore constituting tho city. Its
northern boundary oxtouda 15 miles from
the City Hall Park, being only threo miles
further north than tho Harlem river at its
junction with the Hudson. Fully oue-half
of the anuoxod territory is nearer to City
Hall than tho northern portions of tho old
city. By tho acquisition, only about 45,-
000 people are added to the population of
tho city, bat it is anticipated that tho por
tion auuoxod will inure rapidly fill up
hereafter.
Tho main objoot of tho Herald's map
and oommouts is to show tho nooosaity of
“rapid transit" throughout tho city. It
aays that it now takes nearly two hours,
by horso cars, to travol from tho upper to
the lower portions of the city, and that
this is more timo than business or labor
ing people can spare. What it contends
for is stonm railroad lines, with a rapid
rate of speed, from the battery lo the
northern limits of the city, so us to eu-

No doubt some of our readers \
puzzled, yostorduy, about tho “moieties"
controversy, which was tho chief topic of
our Telegraphic department. It relates
to an alleged imposition which has been
practiced iu tho ouforoomont of the llov-
enuo laws. Detectives are put to work
to ferret out frauds of importing tuor-
ohants, and are promised a “moiety" of
what is recovered for violations of the
law. Merchants complain that for slight
and unintentional “irregularities," arising
nomntiiuea from their not fully undor»l Hid
ing the law and customs regulations un
der it, they aro obliged to pay eiiouuous
Hums by way of “compromise" to save
their goods from confiscation. Ono case
is mentioned, in which it is said that a
Now York importer of sugar, for n mis
take not of his uwu making, was charged
with having forfeited tho whole cargo,
worth $54,000, and had to “compromise"
by psyiug $10,000—every dollar that he
hud. Mr. Downing was charged with
cheating the government out of $240,-
000, and “compromised" tho matter by
paying $30,000. Other cases are referred
to in our telegraphic report.
Mr. Dodge’s statement of his case is
that the books of bis firm (Phelps, Dodge
A Co.) were seized: that the whole
amount of underpayment of duties al
leged against them was $1,005, for a pe
riod of five years, and tho total smouut of
undervaluation $0,050 ; that during this
period they had imported goods to tho
amonut of $40,000,000; that tho chief
maunger making accusations against them
was a government officer named Jayne,
and that Ben Butler falsely stated that he
had a letter which would convict them on
Jayne’s charges ; that by this means they
were forced to pay the so-called compro
mise of $271,000.
Now of course wo cannot say whether
these importers wilfully violated the law,
and made themselves justly liablo to con
fiscation of their goods, or not. But the
“compromise" part of tho business and
the “moiety" rewards to detectives appear
to us to bo expedionts unworthy of the

Cowart announced his decision refusing
bail to Chisolm. Tho counsel for tho
prosecution had applied to Judge Hop
kins, of tho Buporior Court, for a writ of
ohibition restraining Judgo Cowart, of
tho City Court, from proceeding in tho
habeas corpus trial. Judgo Hopkins do-
1 the writ, on tho ground that tho
/ Court was not “an inforior court" in
its rotation to tho Buporior Court ; bnt at
tho same timo ho doolared that the Judgo
of tho Buporior Court alone had tho power
to take bail in capitul cases. Fortified by
this opinion of Ju lgo Hopkins, the coun
sel fur tho State, on Wednesday, deter
mined to withdraw from tho trial of tho
coho boforo Judgo Cowart, relying upon
their ability to huvo his order sot aside if
ho Hhould grant bail.
After thoir withdrawal, nnd after hear
ing argument from Chisolm’s counsel,
Judgo Cowart delivered tho following
opiuiou :
