Prince Bismarck, in Iris execution of the religious lows, means to carry out the policy of the celebrate,l Strat ford unit make his work "thorough." Evidently he will have no compro mise with tho Catholic Church or any of its servunts. It is not lone since lie arrested noble Catholic Indies for venturing to sympathize with the misfortunes of their bishop. He has expelled foreign priests who happen ed to be travelling through German} on errands of pleasure and observa tion. He has token clergymen from the ultor in the performance of the holy oflices of religion and con veyed them to prison. The lust news is that “he lias closed the Roman Catholic seminary at Fulda, expelled the head priest from German territory ami se piestrated all the property of the bishop of that di ocese.” Fulda is a province of Hcsse- Cussel, near the borders of Havana. It is a part of the former bishopric or principality of Fulda, one of the old est eeefesiastieal endow,,,, tits of Ger many, and was for age:, subject to the heau of the famous Benedictine Ab bey of Fulda. Therefore, in striking at the head of -this Order, the Prince overthrows an Institution that may be called traditional in German his tory, and indicates that Iris policy in dealing with Borne will bo implacable and uupnusing. The Bishop of i’a dorborniato be interned in the lor tress of Wesel,— X. E Jlrriih!. - • Havanas it. lie, Jan. 7, 1x7.',. Editor of Hit' .Tonruol (if ('omiin'r: r; Will you please answer u through your valuable paper the following questions: If a party living in the interior sends us a draft on a jiurty here at one day's sight, with bill of lading attached for 100 bales of cotton, and on acceptance of that draft we give up the bill of lading, and the party accepting tho draft fails to pay it at maturity, can party from interior hold us for amount of draft, we charging no commission for collect ing? If IVC act as brokers or li,-ink ers, and cliargo a commission for col lecting, can they hold us for amount thereof? lit either com, whether as bankers or brokers, or not, we have no instructions from party in interior. Savannah. I diep/t/.—The question is one of fact as to due dilligenee to be determined in each case by the circumstances thereof. Two or three years ago a Hour dealer in Richmond sold to a customer in Philadelphia several bills of‘'shorts,”drawing at sight there for and pinnSßg the bill of lading to the draft, deposited the papers in his own bank, the draft usually going to his own credit, and tin- Rich mond bank forwarding the same to Philadelphia for collection. The Philadelphia bank then collected the draft and gave the lull of lading to the drawer. After several such trans actions), the buyer wrote to the seller requesting him to draw at one day'-. K jgTtt, a* tho draft came -.o much in u<|. vitrice of the property. This was done upon tho uext shipment, the papers being sent in the same way without instructions. The Philadelphia bank, upon then -of the draft by the drawer, delivered him tin- billot lading. <me in possession of the property, he im mediately converted it to iris own use and allowed the draft to go unpaid. The ease was submitted to us, and we decided that the Philadelphia bank had no right, under tin- circum stances, even without, instructions, t.> ■separate the bill of lading rr,.m the p.aft. and must therefore boar tlm IdsS, That bank did nut acquiesce in tlris view at first, and the Richmond bank, which had paid the drawer the money, charged it back to Iris account. Subsequently the Philadelphia bank reconsidered its decision and volnn turily jiaid the amount of the draft, charging it to profit and loss. In all eases, unless tin- collecting bank has some reason to infer that a separation of the tw o papers is de sired or authorized by the drawer or his immediate agent, it should insist on payment or security before deliv ering the title to the property repp sphradtiy the billof lading, in our judgment, the <-ollcet.br, without in structions expo-ssed or implied, sur renders tho bill of lading at iris risk and peril, and if tin- draft is not paid, is bound to make it good. .V< i< IV/.
