Solomon Plott vs. Warren C. 11 uff, as
sumpsit. Dismissed by plaint Iff.
Six cases were continued. Tills finished
the call of this docket as far as His Honor
could go for tho present.
Tho Claim Dock t was then taken up,
and three cases of levy were dismissed,
two contbmod, mid live settled.
Juliet McDaniel, plaintiff in A fa., vs.
John W. Edwards, defendant, and Marion
C. Edwards, claimant. At the hour of ad
journment tho court was engaged in the
trial of this case, and a jury Was nut In
tho case of Wm. A. McDougald vs. Harvey
Moscly, and up to six o'clock lin/1 tailed to
make a verdict. This was an action
brought, for the recovery of a balance of
S3OO which had been deposited in tho
hands of defendant by the plaintiff as a
forfeit fora future failure to perform an
agreement. The defendant placed the
money, sl,ooo. In the Banking House of
John King, mixing the same with his own
funds. A few days after the deposit tho
Bank failed. King went into bankruptcy
and defendant received *2OO dividends and
paid tho same to McDougald. On the
trial tho plaintiff claimed to have Instruc
ted tho defendant to make a special de
posit, and the defendant testified Hint <n
receipt of the money that he went to the
Bank, remarking to (ho teller, “I have

Ddugald nnd Chambers, which I want to
deposit,’' and the same was deposited with
his own private account. Able arguments
were made by Maj. 11. J. Moses for the
plaintiff, and John Peabody, Esq., for de
fendant. Various points were raised during
the trial; among thorn was one in which
counsel for defendant duiraed that it was
a gaming transaction mid therefore void.
The jury last night were brought down
and a mistrial declared.
In our report of tho proceedings of
Wednesday wo made an error In stating
that judgment was rendered against the
plaintiff In the case of I’tiu vs. R. it. Ex
press Company. The judgment was in
favor of Pou to the amount of $lB2 23.

The fire til Lumpkin was the act of an
incendiary. Information was received
hero yesterday to the effect that two ne
groes had boon ouught in tho woods near
Lumpkin, In the very aot of dividing the
jil under anil goods taken from Stokes A
Kimbrough's store. They confessed to
tho robbers - , and said they fired tho store
to cover up the theft. They were taken to
jail. It is said their confessions Implicates
a white man In tho neighborhood, but as
yet the white is not in arrest.

good, and- thinks ho will be able to make
all tho collections hi the time proscribed.

15th of December, the law Imposes the
Imperative duty mi Mr. Andrews, us Col
lector, to have executions issued against
delinquents and placed in tho hands of an
ntllcer for levy. You will stive trouble, an
noyance aud cost by settling before that
time. Times are hard, but taxes must be
paid, and the law has provided a very
summary process for their collection.

pose of raising funds to buy an organ for
tho Sabbath school. The entertainment
takes place at the Central Hotel, and is
under the charge of a number of ladies of
