CAPTAIN’S CHARGES
CADSE HIS ARREST.
Dr. Rowland Institutes Criminal
Libel Proceedings Against
His Accuser.
BOTH SIDES OF THE STORY GIVEN.
Capt. Cummings Gives $5OO Bond, and the
Hearing Will Occur Before Judge Hitch
As Soon As Witnesses Are Obtained.
Dr. A. A. Rowland yesterday morn
ing swore out before Judge Hitch a
warrant charging Csptain Arthur L.
Cummings, of Boston, master of the
schooner Thelma, with criminal libel.
Captain Cummings was arrested by
Constable Gaskins. Bond was Used
at SSOO by Judge llitch, and Mr. E. H.
Mason signing it, the captain was re
leased from custody.
The story back of the arrest is a long
one, but first became public property
on Monday morning, when the citi
zens of Brunswick, picking up circu
lars which were scattered promiscu
ously on the streets, were surprised to
read in large type a recital of serious
charges against Dr. A. A. Rowland, a
well-known Brunswick physician. The
circular was signed Arthur L. Cum
mings, and alleged that Dr. Rowland
had, to secure the payment of an un
just bill, attempted, by legal process,
and undercover of the night, to take
the very bed on which his wife lay dy
ing, and, further, that he would have
had the constable to do so had not a
‘•true southern gentleman shamed
him.” The circular was denunciatory
in the extreme, and closed with the
declaration that the captain would be
in the city for the next ten days.
Dr. Rowland would make no state
ment for publication on Monday, but
yesterday after the criminal process
was begun he gave a Times man his
side of the case.
Dr. Rowland says that Captain Cum
mings, whose'wife was very ill with
consumption and being treated by
him, at the home of Mrs. Middleton,
declared to him (Dr. Rowland) that he
never intended to pay his bill; that he
attached the furniture, with special
instructions to the oflicer not to dis
turb the lady, but simply to prevent
Captain Cummings from taking it
away; that the statement that he
tried to take the furniture at night is
false and malicious, as will appear at
the trial, and that he took the legal
steps to prevent being defrauded by
the captain who had sworn that he
would not pay a cent of the bill. Dr.
Rowland also alleges cruel remarks
made by the captain to his wife, in hie
presence, which will probably come
out in the hearing.
justice Hitch has not yet set a date
for the preliminary hearing, Captain
Cummings desiring to obtain his wit
nesses. Among these is Mr. Gus Mid
dleton, who, it is alleged, was present
on the occasion referred to in the cir
cular, and who was the “true south
ern g* ntleman” alluded to by the cap
tain.
The circular and the resultant ar
rest was the subject of general discus
sion yesterday. Dr. Rowland’s
friends claim that he will be vindi
cated by an investigation and that the
charges are• malicious. The captain
also has a number of friends that
champion his side of the case.
Messrs. Johnson & Krauss have
been retained by Dr. Rowland and
Judge Symmes by Captain Cummings.
Died in Jail.
Viola Burke, colored, died yester
day morning at tlie county jail, where
she had been held, awaiting convey
ance to the state lunatic asylum. The
woman was adjudged insane about
two weeks ago. She kindled a lire in
a closet of one of the city hospital
buildings about a month ago, result
ing in the destruction of the buildin g

Officer Jerry Wilcher yesterday ar
rested and jailed a negro for sleeping
in the union depot.
Rev. Troy Beatty, of Darien, has ac
cepted lhe call to the rectorship of
Emanuel Episcopal chuicb, Darien.
Gen. and Mrs. Clement A. Evans
will arrive Saturday night, and will
be the guest of Dr. and Mrs. J. M.
Madden at Bay Vlew.
Dr. H. M. Branham left last night
for Fort-Vailey; to attend Die wed
ding of Miss Fannie Branham, his sis
ter, to Mr. R, Houser. The wedding
occurs today.

Mrs. J. C. Stiles delightfully enter
tained the Acacia club at her home on
Union street yesterday afternoon. A
large number of guests were present,
this being the first meeting of the club
since Lent.
A drunken Spanish sailor stumbled
and fell on the sidewalk near Brady’s
store yesterday afterneon, cutting a
gash in his head. Officer Jones took
the man io a dray to police headquar
ters and docketed a case of drunken
ness against him.

Brunswiok’s Case.
Lieutenants Frank D. Aiken and
Jan es S. Wright are in Atlanta to
present the case of the Brunswick
Naval Reserves in the contest for bat
talion offices. They will be away sev
eral days anil will appear before Gov
ernor Atkinson and the adjutant gen
eral in the case.

Taxpayers anil property owners are
hereby duly notified that the books
for receiving tax returns of city prop
erty are, from this date, open. When
returning only a fractional part or
parcel of any lot, or acre, or particu
lar piece of property, said returns must
embody a full, clear and complete de
scription of said property, by portion
of town, lot number, metes and bounds
or other sufficient description, no as to
euable a lull identification thereof;
vague and indefinite returns shall not
be taken. In case of estates the re
turns must be made in the name or
names oil lie heir or heirs; adminis
trators, guardians, executors, etc,

person or persons for whom they act

persons claiming or owning personal
