that the ROW permit only allowed
Burton to put gravel down in the drive
way. It did not, according to Chris
tian, permit the brick-lined, white rock
“Bahama base” driveway or telephone
call box that was installed.
Burton disputes this with the design
drawing that he submitted with the
permit application. The drawing clear
ly shows the driveway extending into
16th St. past his property line and the
location of the call box.
Nor did Burton understand why the
county removed the driveway three
months after it was built and inspected
by the public works department.
In an interview with The Islander,
Burton said, “We got our permit on
July 17 and it took us about a week to
build the driveway. We finished around
July 25th and then about a week after
that someone from the county’s public
works department came and inspected
it. There was no problem at that time.
Then three and a half months later,
while I’m out of town on a job, the
county comes in and tears it out.”
Burton also explained that the day
the county showed up to remove the
driveway, he had a pile of sand and a
concrete mixer also sitting on county
right-of-way.
“I think they thought the driveway
was under construction and that per
haps it was going to extend farther out
into the right of way,” said Burton, “but
that was not the case. The driveway
had been finished since July. The sand
and concrete mixer were being used on
a renovation project on another part of
the house.”
Burton’s father had construction
workers move the sand and the mixer
off county property the same day Paul
Christian responded to a citizen’s com
plaint about the driveway.
Burton’s final point about the inci
dent, one that caused him some heart-
bum, was the response from other
people.
“My family has lived on St. Simons
some 30 or more years,” said Burton,
“I’m not trying to steal anything. I’m
not trying to steal the use of property
that’s isn’t mine. I’m not trying to get
over on the county. I followed their
rules. I got the permit and had the
driveway inspected after it was built.
And then this happens. I know they’re
not going to give me my $8,000 back,
but if the right-of-way permit is no
good they could at least give me back
the $100 fee I paid for it.” □

Should I take my home off the market during the holidays? Many sellers
