On February 4, 2009,
1997 Ford F-150 Red in
color Tag# AIY7373 VIN#
1FTEX18LXVNC01937 was
seized for administrative
forfeiture from KELLY SUE
COOPER, at Danielsville,
Georgia, for violations of
Official Code of Georgia
Annotated Section 16-13-
30 (Violation of the Georgia
Controlled Substance Act).
The conduct giving rise to
the forfeiture is as follows:
On 02-04-2009 Scott Anthony
Moore was stopped by a
patrol deputy with Madison
County Sheriff’s Office while
driving Cooper’s truck.
Moore’s license was found
to be suspended. Search
Incident to Arrest revealed
that Moore was in possession
of 87 Loritab pills (Schedule
III narcotic), 3 Klonopin pills
(Schedule IV narcotic), and 3
Percocet pills (Schedule II nar
cotic). The truck was turned
over to the registered owner
at that time. On 02-05-2009 I
assisted Probation Officers in
a Fourth Amendment Waiver
search of Cooper’s residence.
I took an Innocent Owner
Waiver to serve to Cooper in
reference to Moore’s arrest
in her truck. I read Cooper
Miranda Warning and asked
her if she would like to talk to
me about Moore and she stat
ed she would. Before I could
explain the Innocent Waiver
Form Cooper told me that
she had personal knowledge
of Moore buying and selling
pills. At that time I explained
to Cooper that I was seizing
her truck for the pill violations
and that she was not con
sidered an innocent owner
based on her confession.
Pursuant to Official Code of
Georgia Annotated Section
16-13-49(n) this property is
subject to forfeiture. Any
person claiming an owner
ship interest in this property
may file a claim within thirty
(30) days after the second
publication of this notice by
sending the claim to the seiz
ing agency and to the district
attorney by certified mail or
statutory overnight delivery,
return receipt requested.
Otherwise, the property will
be forfeited and disposed of
according to law.
