Athens man arrested after fleeing from deputy
An Athens man was arrest
ed last week after he fled
from an officer who identi
fied him as a wanted felon.
Benjamin Wayne
Malanoski. 27, was charged
with a probation violation,
obstruction, acquiring a
license plate for the purpose
of concealing the identifi
cation of motor vehicle, no
proof of insurance, hit and
run; duty of a driver to stop
at or return to the scene of
an accident, reckless driv
ing. passing in a no passing
zone, driving while license
suspended or revoked (fel
ony, fourth or subsequent
offense), fleeing or attempt
ing to elude, speeding, no tag
and a seat belt violation.
Deputy Mark McCarty
was traveling north on Hwy.
106 when he spotted a white
Ford Taurus that matched the
description of Malanoski’s
car. Malanoski fled in his
vehicle with McCarty in pur
suit as he zigzagged in and
out of traffic on the four-lane
road, according to the inci
dent report.
McCarty caught up with
him near Neese-Commerce
Road and activated his blue
lights. Malanoski continued
to travel at speeds of more
than 100 mph, according to
the report.
After passing the inter
section at Sanford Road, he
decelerated to approximately
90-95 mph and then attempt
ed to make a right hand turn
onto Norwood Road, slid
ing across the roadway and
going airborne before strik
ing the ditch and traveling
another 100 feet before his
vehicle came to rest.
Malanoski then fled on
foot. Law enforcement offi
cer established a perimeter
with deputies and GA State
Troopers while the K-9
unit from Alto State Prison
was summoned. Officers
searched the area, eventual
ly apprehending Malanoski
without further incident.
In another arrest, Henry
David Mack, 45, of Comer,
was arrested for aggravated
assault and battery FVA.
On July 30, deputies
responded to Holly Creek
Church Road to meet with
a woman about a domestic
dispute with her live in boy
friend (Mack).
She said Mack punched
her in the face and pulled a
gun on her at their home on
Francis Hill Road.
She said she confronted
Mack about a second cell
phone she said she found ear
lier in the day that revealed
he had been texting other
women.
Later in the evening, she
said the two got into a verbal
dispute in the yard. She was
in her car attempting to leave
when he allegedly confront
ed her again and punched
her in the face, leaving her
with a bloodied nose and a
swollen face.
She said she pulled down
closer to the house to retrieve
her daughter and Mack went
inside and came back out
with a shotgun.
She said Mack “drew
down on her and ordered
her to get out of the car.” She
refused and quickly left the
area. Mack walked out into
the field with the gun as she
drove off.
Deputies relocated to
Francis Hill Road in attempt
to make contact with Mack.
He was located standing
in the field out in front of
his residence with his sisters
who were attempting to calm
him down. He told deputies
to just “put him in hand
cuffs” and refused to speak
about the incident.
An additional attempt
was made to talk with him,
according to the report, but
Mack still refused. Officers
noted he smelled of alcohol.
Mack did tell officers that he
had several guns but that they
were all were in the house
and were unloaded.

Couple reports missing and ‘possibly endangered’ daughter
A couple went to the Mad
ison County Sheriff's Office
last week to report that they
feel their daughter might be
in danger.
On July 28, deputy Adam
Arnold met with the cou
ple about their missing
and “possibly endangered”
daughter. They explained
that their daughter had not
been seen since July 14 or
heard from since July 21.
They said they suspected
she is with three men who
are allegedly involved with
illegal narcotics, have a vio
lent criminal past and might
have a handgun.
They said they believed
she had been taken without
her consent.
The mother said she
received a call the day before
from one of the men who
told her her daughter had
been raped several times and
had been given IV drugs.
She said the sister of two
of the suspects had called her
that day. Arnold talked with
this woman by cell phone
who stated her brothers were
possibly driving a black or
blue beat up pickup truck.
The vehicle was described as
having a lift kit, big tires and
wheels that has been used
for hauling pine straw. The
vehicle may have hay bale
strings attached to the side
of the vehicle. She said that
a handgun might be located
under the driver's seat.
She also stated the suspects
could possibly be driving a
little blue car that has severe
damage. She was unable to
provide the address of the
suspects or the vehicles’ tag
numbers. However, she said
she has been in contact with
her brothers and is attempt
ing to meet up with them at
a Kroger store in Duluth to
get the victim some medical
assistance.
She was instructed to call
9-1-1 in that county for
assistance and to call back
to Madison County if she
received more information
on the victim’s whereabouts.
Other incidents reported in
the county last week includ
ed:
•A home burned on Farm
Road near Colbert last week.
The home was a total loss,
according to Colbert VFD
member Tim Wyatt. No one
was hurt in the blaze, which
was reported at about 1:41
a.m. on July 30. The Red
Cross was called to assist the
family.
•A woman on Long
Peeples Road went to the
sheriff's office to report a
phone scam. She told dep
uty Joshua Smith that she
completed paperwork to
enter a Publishers Clearing
House Sweepstakes and then
received a call stating she
was a winner, but needed
to send $200 for a one-time
processing fee. She sent the
money to “Winston Gran-
ston” in Jamiaca by West
ern Union, according to the
report. She said she was
contacted again by a woman

told her she now needed to
send tax money on the prize
to the IRS. She then began to
think it was all a scam, she
told the officer. She said she
did not give any identifying
information to the people she
spoke with.
•A woman went to the
sheriff’s office to report
harassing communications
over social media. She told
deputy Shawn Rhoades that
this has been going on since
the beginning of summer
and now has gotten to the
point where the victim’s Ins-
tagram accounts have been
deleted and the suspect is
still contacting them through
Instagram.
The suspect is sending
messages that say “you need
to kill yourself’ along with
several other inappropriate
messages.
