Pursuant to O.C.G.A. §l6-13-49(0),
any party claiming an interest in the fol

on the Bth day of July, 2004, the fol
lowing property and currency was
seized by the Warner Robin Police
Department, and there is a forfeiture
action pending against said property in
the Superior Court of Houston County,

The description of the seized prop
erty is as follows: Three Hundred
Nineteen Dollars ($319.00) in United
States currency, one set of electronic
scales, one Kyocera cell phone
#ACN093453037, and one Nokia cell
phone #O7B/03446915.
The conduct that gave rise to the
seizure of the above describe property
is as follows: On or about July 8, 2004,
Officer Hydrick with Warner Robins
Police Department made a traffic stop
on a 1992 Acura being driver by
Timothy Barrett. While waiting for dis
patcher to run computer checks on the
driver and passenger, Mark Gust, a
drug detector canine alerted on the
vehicle. The GCIC check showed that
Mark Gpst had open warrants. Gust
was arrested and the vehicle searched
incident to arrest. Police found
Oxycodone pills, Xanax pills, several
syringes (including one that was
loaded and ready for use), several
small jewelers baggies, the above
described scales, three hundred nine
teen dollars ($319.00) in cash, and the
two cell phones listed above. Both
Timothy Barrett and Mark Gust were in
joint, actual or constructive posses
sion. Both Barrett and Gust knew, or
reasonably should have known, that
the illegal narcotics were in the vehicle.
This property is forfeitable under
O.C.G.A §l6-13-49(d) (2), (3), (4),
and (6) in that it was found in close
proximity to the contraband, repre
sents proceeds from illegal drug activi
ty, and was possessed, used, or avail
able for use to facilitate a violation of
the Georgia Controlled Substances
Act.
You are hereby notified that you
must file an answer to the forfeiture
action which complies with O.C.G.A.
§l6-13-49(0). within thirty (30) days of
the date of final publication. Said

Deputy Chad Payne stopped a vehicle
being driven by Michael Gauthier for a
traffic violation. A drug detector canine
did a free-air sniff around the vehicle
and gave a positive alert to the pres
ence of narcotics. While searching the
vehicle, deputies found two separate
bags containing suspected cocaine.
The substance tested positive for
cocaine. The total weight of cocaine
was approximately 4.00 grams.:

(2), (3), (4), and (6) in that it was found
