Pursuant to O.C.G.A. §l6-13-49(0)
and O.C.G.A. §9-11-4(1 )(C), any party
claiming an interest in the above listed
property is hereby notified that on the
day of , 2004, a
Complaint for Forfeiture was filed in
the office of the Clerk of Superior
Court.
The conduct that gave rise to the
seizure of the above described proper
ty and currency is as follows: On or
about December 10, 2004, investiga
tors from the Warner Robins Police
Department executed a search warrant
at Superior Mini Mart, 2509 Moody
Road, Warner Robins, Houston
County, GA, in reference to illegal
gambling at that location, i.e. cash pay
out on December 2, 2004. Officers
seized the above-described cash and
property at that business, Superior
Mini Mart, which is owned and operat
ed by Rameshchandra Patel. The
video machines listed above are “gam
bling devices” as that term is defined in
O.C.G.A. 16-12-20(2)(B),(C), and (D).
The location is a "gambling place” as
defined in O.C.G.A. 16-12-20(3) in that
one of the principal uses of which is the
playing of gambling devices. Cash
payments were made to customers
who received certain winning combina
tions while playing the video gambling
devices. The gambling devices were
used in illegal gambling, to wit: to facil
itate commercial gambling as defined
in O.C.G.A. 16-12-22(a)(1); to facilitate
keeping a gambling house as defined
in O.C.G.A. 16-12-23; and possession
of a gambling device, O.C.G.A. 16-12-
24. The cash listed above is proceeds
from the illegal gambling activity more
fully described herein. The machine
owner(s), Habtamu N. Setegene, indi
vidually knew, or by the exercise of
reasonable care should have known,
that the seized machines and cash
were used to violate O.C.G.A. 16-12-
20 et seq. or were the proceeds from
such illegal gambling activity.
Further, the Judge of the Superior
Court issued an Order to Serve by
Publication on May 2, 2005.
You are hereby notified that you
must file an answer to the forfeiture
action which complies with O.C.G.A.
