Honorable Asha F. Jackson in the
DeKalb Superior Court on May 6,
2014 respectfully submits the follow
ing presentments.
INDICTMENTS
This Grand Jury was presented with
(442) cases during the May-June
2014 term. Of these cases (439)
True Bills and (3) No Bills were re
turned. An additional (285) cases pro
ceeded by Accusation.
REQUEST FOR PUBLICATION
Pursuant to the O.C.G.A. § 15-12-80,
we the presently constituted Grand
Jury recommend to the Honorable
Asha F. Jackson that these general
presentments be published in whole
in the County Legal Organ.
Commendations:
We the members of the May-June
2014 DeKalb County Grand Jury,
would like to commend the profes
sionalism of the Assistant District At
torneys, law enforcement officers, in
vestigators, detectives and support
ing staff. We recognize their intens
ive case loads and general under
staffing, hence commend their dedic
ation and service to the county. Our
questions were answered promptly
and our needs fulfilled in a manner
which exceeded our expectations.
Our Grand Jury coordinator Jamita
Vortice-Bowden was wonderful to
work with and extremely supportive of
the jurors.
Orientation:
The orientation given by the ADA was
informative. The video presentation
of the legal system and the Grand
Jury’s role was enlightening. The DA
investigators presentation of various
weapons, gang activity and narcotics
from prior cases was alarming and
put in perspective what we were em
barking upon. I would recommend
that the initial Grand Jury pool be ex
panded, our session had only the
minimum amount of eligible jurors for
the term which seemed to cut it very
close. This expansion would give
both the ADA and the potential Grand
Jury member’s greater flexibility in
the selection process.
The seriousness of our responsibility
needs to be emphasized during ori
entation. Included in this would be:
• If the Grand Jury member exceeds
the absence policy, we recommend
that the consequences be better
defined; such as they are removed
from the panel and be made to serve
on the next session.
• Timeliness should be emphasized
• Having a glossary of charges and
investigative terminology which will
be heard by the Grand Jury would be
beneficial at the orientation.
• Spending more time explaining ex
pectations and requirements of the
Grand Jury during orientation would
be helpful, such as the minimum/
maximum required participants to
vote on a bill, the amount of votes re
quired to true bill.
• Better explaining the abilities of the
Grand Jury to bring investigations or
change bills as this seemed to be a
point of confusion throughout the
term.
• Explanation of the ending present
ment should also be mentioned and
explained during the orientation.
General Observations during the
May-June 2014 Term:
We recommend that all officers
presenting cases review and be
come familiar with the cases prior to
taking the stand. When officers did
not know their cases it took extra
time, created confusion with the pos
sibility of leading ultimately to incor
rect conclusions.
All electronic devices need to be
turned off before entering the Grand
Jury room, this includes not only the
jury but officers of the court.
18 sessions may not be a necessary
term, 10-12 would appear more ap
propriate especially considering that
we were released by 2pm and fre
quently earlier on each day. A more
robust day with less required days
seems more efficient for all involved
as we have yet to hear all the cases
on each docket sheet for each ses
sion.
We recommend having no more than
3 indictments presented per lead in
vestigator at one sitting as this makes
it hard to remember each case when
it comes time to vote.
Allowing for video testimony by wit
nesses whose precincts are far away
from the courthouse may streamline
the process making it more efficient
for witnesses and would prevent of
ficers/ investigators who are forced to
travel far distances to the courthouse
for a 5 minute presentation. This in
evitably takes them away from cover
ing their cases and/or the patrols.
The Grand Jury was informed that
other states and jurisdictions did not
always keep their record databases
updated, which led to arresting of
ficers not realizing criminals had war
rants or priors; we recommend that at
least DeKalb county make it a top pri
ority to keep the criminal databases
updated.
Delays in Indicting Cases:
While we understand there are many
factors that can contribute to cases
being delayed in reaching the Grand
Jury for indictment, we are con
cerned about a significant number of
cases being presented to the Grand
Jury for crimes that had occurred
more than one year ago; and in many
cases more than two years ago, prior
to presentation. We are even more
concerned about the frequent inabil
ity of the presenting ADA to explain
the reason for these delays. Several
ADA’s provided general explanations
of reasons that might lead to a delay,
but only in a few cases were they
able to state the precise reason that
actually applied to the case in ques
tion. The Grand Jury’s concern is that
delays of these lengths are some
times, perhaps often, occurring due
to either understaffing of the DA’s of
fice (attorneys or investigators or
both), or to inefficiencies in the oper
ation of the DA’s office that may lead
to poor communication and failure to
keep cases moving through the sys
tem. This concern is somewhat rein
forced by the significant number of
errors in bills of indictment—incorrect
dates, misspellings, a few times even
naming the wrong defendants. These
were presented and had to be re
called for correction. We request that
in future terms of the Grand Jury, the
presenting ADAs (1) improve their
quality assurance process to ensure
the accuracy of the bills of indictment
that are brought to the Grand Jury
each day, and (2) in cases where the
charged crime(s) occurred more than
eighteen months prior to the date of
presenting to the Grand Jury, the
presenting ADA be prepared to ex
plain the specific cause for exceed
ing the DA’s stated goals for bringing
indictments (90 days after charging
when defendants are incarcerated,
270 days after charging otherwise).
When cases have exceeded the
standard explanations should be
provided to the Grand Jury. We be
lieve that researching and explaining
the cause for such delays will not
only be helpful in assessing the oper
ation of the criminal justice system in
DeKalb County, but will also help the
DA’s office to better assess its own
operation and perceive and correct
potential defects in that operation.
Jail Inspection:
The jail visit was enlightening; espe
cially considering the county jail is
such a large expenditure for DeKalb
County tax payers. We feel that the
jail is run impeccably well with cour
teous, highly professional and know
ledgeable staff. The jail was clean,
well run and organized. We were able
to tour the fully operating law library,
GED/ literacy program, pharmacy,
dental office, dialysis unit and infirm
ary which are impressive. We com
mend the prison-worker program that
allows those inmates who have
earned the responsibility by good be
havior to assist in the operation of the
jail facilities, such as the kitchen and
laundry room. In speaking with the
jail staff we learned that not only
have they gone 8 years without a
raise, but they are training new hires
and frequently losing them to higher
paying jurisdictions. This is not only a
waste of resources for the county to
train and lose staff, but a disappoint
ment to the Grand Jurors that the
county is not paying its staff com
mensurate salaries with surrounding
counties. It is our recommendation
that the Board of Commissioners im
mediately increase pay to match that
of the surrounding counties. It is also
our recommendation that an annual
jail tour is a mandatory requirement
for all members of the Board of Com
missioners as they control the alloca
tion of resources to the facility. Our
observation of the GED and literacy
program is that it should be expan
ded to help enable the education of
prisoners in hopes of a reduction of
re-recidivism. Three instructors are
not adequate for a prison of 3000 in
mates. We also believe that life-skills
classes such as resume building, job
applications, basic internet usage,
etc. could greatly help inmates as
similate back into normal life after
prison. We were also disappointed to
find that the infirmary was requiring
double bunking of sick inmates as
this can cause obvious cross contam
ination of illness. The jail library and
education program could greatly be
nefit from updated computers and
better resources.
Prior Grand Jury Presentments:
In reading through several of the pri
or Grand Jury Presentments, we are
disappointed to see that many re
commendations are not heeded and
seem to go unanswered. It appears
that there is no responsibility levied
on any form of DeKalb Government
or the Board of Commissioners to vet
the requests of the Grand Jury. Re
peating the same comments term
after term with no action is a repre
hensible way to recognize the ser
vice and well-intended remarks of our
citizen jurors.
Concluding Remarks:
Serving on the Grand Jury was an
eye-opening experience and true
privilege. We better understand our
own community, its citizens and
formed camaraderie amongst
ourselves and the staff. We are all
grateful the privilege to serve DeKalb
County in this manner.
