BIKES ARE BAGGAGE
A St* Louis Judge Renders an Important
Decision on Wheels
ROADS MUST CARRY THEM FREE

Judge Russell, of St. Louis, has decided
that bicycles are baggigeard must be
carried free by railroads.
This is a very important matter to the
railroads. Here in the south most of the
roads are now checking wheels on the pay
ment of 25 cents. Some of the toads will
carry .a wheel free without a check, but
that is risky, as several wheels have been
lost in that way.
The decision by the St. Louis judge was
in a suit brought by J. R. Bettis against,
the Missouri Pacific Railway Company,
which refused to carry his bicycle unless
he p lid 25 cents, the regal w charge.
An order to show cause was issued ano
the company moved to qua«h the alterna
tive writ. Judge Russell first discusses
the question whether mandamus is the
proper remedy in such cases, and he con ■
eludes that it is, and that the suit may be
brought by a private party. Any citizen
may bring a suit where a public ngnt is
involved, and a writ of mandamus is the
remedy when a corporation fails in its
duty to the public. In a case like the
present, mandamus seems to be necessary
to avoid a multiplicity of suits.
“Then the question presents itself;
Is a bicycle baggage? Judge Russell
discusses the matter at some length, and
finds that the law regards baggage to
include not merely articles of personal
apparel, but also other articles with ref
erence to one’s immediate necessities,
but to the ultimate puipose of the jour
ney. An artist’s easel, a sportsman’s
gun case and a sailor’s telescope, have
been held to be baggage. On this point
the judge says that not everything which
only a crank or an eccentric person
would take with him u considered as
baggage, and he a< ds: ‘ ‘lt is true that
it has not been many y lars since those
addicted to bicycle riding were regraded
as cranks, but his-class has grown and
his t-ibe has multiplied until it threat
to include all mankind, and we are
forced to accord the wheelmen the
avorare human intelligence, and we
cannot now say that only a crank would
carry with him a wheel.”
A bicycle then comes within the rule.
The judge finds that it is a machine or
vehicle in very common use among a
large class of people for health, r.crea
tion and locomotion, and is largely used
at the end of a journey for health or re
creati' n. Bicylists form a decidedly
large class, and the courts must take no
tice of them as of other matters tha 1 ; im
press themselves ou the senses. It would
be foolish for the courts to assert, in view
of what they see every day, that the
wheelmen do not compose a very sub
stantial part of the community. In con
clusion Judge Russell overrules the mo
tion to quash the alternative writ,

that all of the local postoffiees at that
p'ace will be consolidated and that"all

fiom the Cincinnati postoffice proper in

and converted into stations as named.
This experiment has been tried with
fruitful results at Baltimore, and Post
master Brown, of Cincinnati, is now
awaiting orders to biiag the work in
his territory. The law provides that all
postoffiees within a radius of five miles
of the largest office in the territory shall
come under the civil service iu]e as pro
vided.
Postmaster Dem< nt was seen by a Chrft

me that the postofflee would be con

when. At that time he said it was im
possible to say when the work would

"I am of the opinion that all small
postoffiees will be made stations, hut
this remains to be seen. Nothing h is
been done in thiscity towards putting
this neiy enactment into force. I un
derstand that when the change does
cOme that the regular postmasters will
be retained at the stations, but their
compensation reduced. The abolish
ing of the small offices will save con
siderable money for the government.
Taking in the territory within a ra
dius of five miles of the city it will cut
out the Hill City, Highland Park,
Ridgedale, St. Elmo and other minor
offices. The Sherman Heights or
Lookout mountain offices will not
eome under this.

per when her husband came home the

“Impudent, Mrs. Juniper?” he re
plied. “You don’t mean to tell me that
you allow that servant girl to be impu
dent to you?”
“Allow her, Mr. Juniper? That girl
.would be impudent to an angel if she
happened to be on her high horse. ’ ’
“Well, I’m not an angel by a long
shot, but I’d like to see her be impudent
to me, and if she’s been saucy to ynu
she’ll have to apologize for it. ” <.

in her present mood. You’d better keep
out of the kitchen.”
