Lieutenant ontrien Resigns.
Atlanta, Nov. 24 —Lieutenant Mi
chael J. O’Brien, stationed at Fort Mc-
Pherson, has resigned as a United
States army officer. He will be remem
bered as having figured in the trial aud
conviction of Captain Henry Romeyn
last spring. The courtmartial attracted
more attention, perhaps, than any other
similar trial ever held in this country.
Lieutenant O’Brien will go to Massa
chusetts to practice law, where he haa
been admitted to the bar.

WHO JUDGE WAYMIRE’ IS.

to Succeed Mr. McKenna.
San Francisco, Nov. 24. Judge
James A. Way mire, who, it is said, ia
likely to be made attorney general when
McKenna is appointed to the supreme
bench, knew President McKinley in hie
boyhood and nas been an aspirant for a
cabinet place ever siuce McKinley was
elected.
Judge Way mire wal<a member of the
lower house in the last aud
with the other members from Alameda
county, had beeu pledged to support
Perkins for re-election to the United
States senate. He sought to secure a
pledge from the legislature to recom
mend him for a cabinet place, in return
for his support of Perkins. The Perkins
legislators refused to make the promise
and demanded that he keep the pledge.
He wavered for a time, but finally cast
his vote for Perkins.
At present Judge Waymire is prac
tising law in this city. He was born in
Missouri in 1842. His early life was
■pent in Oregon. He tanght school for
a time, served for three years is the
war against the Indians, and in 1870
was admitted to the bar. He came to
San Francisco in 1874. In 1881 Senator
Perkins, then governor of California,
Appointed him to a vacancy on the su
perior bench of this city, which posi
tion he held until the following election.
