to Vidalia Federal Savings Bank,
dated September 27, 2017, filed
on October 5, 2017, and recorded
in Deed Book 1197, pages 206-

County, Georgia, which secured
a promissory note from Eddie D.
Toole to Vidalia Federal Savings
Bank in the original principal
amount of $167,000.00, there will

LESS AND EXCEPT: A 5.19 acre
tract located in the Northeast cor
ner of the above property which
was conveyed to H.J. Fowler by
Warranty Deed dated August 30,
1974, and recorded on Toombs
County Deed Book 133, page
208; and said tract being more
particularly described by a plat of
survey by C.G. Alexander, Sur
veyor, dated August 27, 1974 and
recorded in Toombs County Plat
Book 10, page 357.
Subject to any rights to any well
or water system agreement which
is owned by Grantor to this prop
erty. If the within property is fore
closed upon, Grantor grants the
Grantee their successors and/or
assigns the rights to use water
from the water system at the rate
of the water system for residential
uses at that time.
Also subject to any existing water
line or water line easements as
they may exist on the above de
scribed property.
As a covenant running with the
land, Grantor places the following
restrictions on the land as a cov
enant running with the land and
binding on Grantees, their suc
cessors and assigns. Grantee
shall not place a hog pen, a
chicken house or a junk yard on
the property.
The indebtedness secured by
said Deed to Secure Debt having
been declared due and payable
because of default in the payment
of the indebtedness secured,
thereby this sale will be made for
the purpose of paying the same
and all expenses of the sale, in
cluding attorney’s fees, notice of
intention to collect attorney’s fees
having been given as provided by

A copy of this legal advertise

Power) which was sent to the
