no permanent paving occurs thus
not correcting the roadway sur
face erosion control issues and
providing a safe travel way during
and after heavy rains. By not up
grading water system, the Target
Area will continue operate on an
as is basis. Even though this al
ternative is less expensive, it is
does not provide a long-term so
lution to satisfy the public safety
needs of the residents. There
fore, this alternative has not been
selected by the County as the
recommended alternative.
As a mitigation measure, a US.
Army Corps Nationwide Permit
14 for linear Transportation proj
ects will be required due to the
disturbance to the surrounding
wetland. This project will be in
compliance with all state and lo
cal wetland protection proce
dures.
Montgomery County has reevalu
ated the alternatives to building in
the wetland and has determined
that it has no practicable alterna
tive. Environmental files that doc
ument compliance with steps 3
through 6 of Executive Order
11990, are available for public
inspection, review and copying
upon request at the times and
location delineated in the last
paragraph of this notice for re
ceipt of comments.
There are three primary purposes
for this notice. First, people who
may be affected by activities in
wetlands and those who have an
interest in the protection of the
natural environment should be
given an opportunity to express
their concerns and provide infor
mation about these areas. Sec
ond, an adequate public notice
program can be an important
public educational tool. The dis
semination of information and
request for public comment about
wetlands can facilitate and en
hance Federal efforts to reduce
the risks and impacts associated
with the occupancy and modifica
tion of these special areas. Third,
as a matter of fairness, when the
Federal government determines
it will participate in actions taking
place in wetlands, it must inform
those who may be put at greater
or continued risk.
