cution and punishment of Indians and d -
st-endanis ot 1 ndiatib’ and persons claiming
& entitled to the privileges of iidfans com
mitting offences against lhe laws of this
slate, and to authorize the Governor to
commute the punishment by imprisonment
in the Penitentiary tn certain cases for the
punishment prescribed by this act.
Sec. 1. Be tl enacted by the Senate and
House of R piesentatives of the State ol
Georgia in General Assembly met, and it is
hereby enacted by the authority aforesaid,
I'hat from & after ihe passing of thi?. act,when
any Indian or the descendant of an Indian, or
a person claiming aud enfified to the privile
ges of an Indian, shall be prosecuted for any
offence against the laws of this State, lie or
she shall be designated in the bill of indict
ment as an Indian or the descendant of an In
dian, or as a wbite person claiming and enfified
to the privileges of an Indian as the case may
be.
Sec. 2. z\nd be it further enacted by the
authority aforesaid’, That when any Indian or
the descendanl of an Indian, or a white per-l
sun claiming and entitled to the privileges of
an 1 niiian. shall be indicted as aforesaid, the
court before which ho or she shall be indicted,
shall hear and determine no demurrer to the
indictment or plea to the jurisdiction of the
court or other plea in abatement or in bar, un
til the defendant shall have announced himself
or herself ready for trial; and in no case shall
he court continue or postpone the trial for any
cause whatsoever after a decision upon such
demurer, plea to the jurisdiction or other plea
in abatement or in bar to the next term of the
court or to an adjournment of the same term
of tho court.
Ser. 3. And be it furteer enacted by the
authority, afoiesatd. That if upon the convic
lion of an Indian, or the descendant of an In
dian ora white peison ciaiinmg and entitled to
the privileges of an Indian, of any offence in
any of il.e courts of this state, a motion shall
he made in arrest of judgment or f<>r a new
trial, the court shall determine on said motion
at the same term of the court at which con
viction is had, and tn no case shall a determi
nation thereon be postponed for any cause
whatsoever, to any siibs. q.ient ipihi of the
court or to an adjournment ofthe same trim.’
Sec. 4 And be it further enacted by the
authority nfor. snid, That upon the conviction
of an Indian or a descendant of an Indian, or
a while person claiming and entitled to the
privileges of an Indian of an offence punisha
ble capitally hy the laws now of force in this
state, the court shall proceed to pass the sen
tence of death «>n 'he defendant, and in”nn case
shall’he court postpone I e execution of said
sentence more than vventy days from the time
of hi« or hei < onvlction:
Sec. 5. And be it further enact, d by the
authority aforesaid, That upon the conviction
of'an Indian or the descendant of an Indian

On motion of Mr. Liddel, the report of the
committee, on tho memorial of a committee
on the part of a portion ofthe citizens of the
Cherokee circuit relative to the J dicial con
duit of Judge Hooper, was taken up and read.
J\lr McDonald, offered as a substitute for
tlm report, the Bill to be entitled an act more
eff dually to provide for the Government of
and prmeciion ot the Cherokee Indians, resid
ing within the limits of Georgia, and to pre
scribe the bounds of their occupant claims, and
also to authorize grants to isssue for lots- dr iwn
in certain cases &c. passed Dec. 1833’ which
was raceived »y a vote of 52 io 21.
