authorised by them to revise, alter and" amend the

to. divorces.
Whereas the said section and article of the Con
stitution of toe State of Georgia, requires alteration.
Be it therefore enacted by the Senate and Housr
of Representatives of the. State of Georgia in Gen
eral Assembh met. and it is hereby enacted by thi
■ authority of the same. That so soon as the fol
lowing amendment shall be passed agreeable to the
(ifteetrth set ion < f the fourth article of ttic consti
’ turion, it -diall be received in lieu of ninth section
of die third article to wit:
••Thai the superior courts of the several counties
in this Slate shall have full power, to decide on
, the last resort in all cases of divorces, in the follow
-1 mg manner, to wit : The parties concerned shall
• bring their case before a.uetit jury, as a common
i issue at law, ana as such the 4 proceedings shall be
had thereon: That ic the verdict is in favor of a
i divorce, the* said cause sbail be put oi. the appeal
1 dock* i ..nd lie tried Jby ? .spe iai jut . and it the
spe ial jury confirm* the verdict of me p tit jury
and the next succeeding grant! jury shall, by their
recommendation confirm the verdicts of the a

act having passed both branches' of-the legislature,
ami having been advertised six months and all the
requisites of ihe constitution complied with, shall
thereaftor be the law of the land in the case of di
vorces.
