agreement of the parties hereto, is

in such a manner as to constitute a
fixture pursuant to O.C.G.A.
§44-1-6(a), as amended, and has as
of the date hereof become a part of
the real property herein described.
Accordingly, said home is to be
treated and taxed as an improve
ment to real property for ad valorem
tax purposes and the owner thereof
agrees to apply for homestead ex
emption or take other applicable
steps to ensure taxation of said
home as real property at the earliest
possible date under the laws of the
State of Georgia. It being the uncon
ditional and absolute intention that
the manufactured housing as last
described shall remain permanently
attached in its place on the realty as
hereinabove described.
Said sale will be con
ducted and a deed executed to the
purchaser pursuant to the powers
contained in a deed to secure debt
from Jason D. Stewart to Bank of
Madison, dated June 9, 2005 and
recorded in Deed Book 3445, Pages
3-8, Clerk's Office, Houston Supe
rior Court. Said deed to secure debt
was executed to secure a promis
sory note between the same parties
of the same date in the amount of
$91,373.50, together with interest
from that date at a rate of 12.818%
per annum, being repayable in 1 in
stallment of $93,350.35 due on June
2, 2006. Bank of Madison is the
owner and holder of said note and
said deed to secure debt which se
cures the same.
Said Jason D. Stewart de
faulted by failing to make the pay
ment according to the terms of said
note and because of said default in
failing to make said payment when
due, and in accordance with the pro
visions of said note and of said deed
to secure debt, the undersigned has
exercised its option to declare the
remainder of the debt due and col
lectible, and the power of sale con
tained in said deed to secure debt
has become operative.
The said Jason D. Stewart
has been notified in writing that the
provisions in said note relative to the
payment of attorney's fees will be
enforced.
Said sale will be con
ducted subject to any State and
County ad valorem taxes which may
due and payable on said property, a
deed executed to the purchaser,
and the proceeds applied in accor
dance with the provisions of said
