These products Right to vote more a state issue than federal Dear Readers, Last we week we learned that a Georgia judge, Fulton County Superior Court Judge T. Jackson Bedford, Jr., ruled Georgia’s voter ID law unconstitution al on state grounds. In look ing at the history of federal constitutional we further learned that the right to vote is actually more an issue of state law than federal law - which would be consistent with Judge Jackson’s ruling. We also saw how the right to vote, a fundamental right for any citizen, has been a blot on our history, in terms of fairness and equality. I had mentioned, in pass ing, that there was some fed eral litigation and that U.S. District Court Judge Harold L. Murphy had twice delayed enforcement of the voter ID for being a “poll tax.” This term, “poll tax,” describes state laws designed to frustrate a citizen’s right to vote, essentially based on race. It was only one of several practices used to do this and was used to deny a citizen the right to vote for failure to pay a tax or fee (hence, the term “poll tax”). There are all other kinds of variations on the same theme (like denying the right to vote to the illiterate) - all designed to deny slaves, and their descendants, freed by war and bloodshed, the right to vote guaranteed by the Civil Rights Amendments of 1870. This practice continued for almost a century, when the issue was squarely faced during the second civil rights upheaval in the 19605. Thus, finally, in 1964, the 24th Amendment finally outlawed the most egregious abuse of the denial to vote by eliminating the poll tax. I want to move on to Georgia’s constitution, but you can see why Murphy’s decision was based, in part, on a finding that the voter ID, which initially required the payment of a fee to buy an ID, amounted to an unconstitutional “tax” on the right to vote. Dr. Jokhai Columnist The Foot Doctor tion, and stated, essentially, that the state constitution very specifically guaran tees the right to vote to all citizens, but only gave the General Assembly the right to legislate the “registra tion” of electors; the state constitution did not give it the right to legislate proof of the right to vote at the polls. What this means is that all duly registered voters have the absolute right to vote; requiring them to have an ID to prove the right to vote at the polls is beyond the right to control the registra tion process. Is this judicial activism? Personally, I think not. Simply stated, the General Assembly has the right only to control registration for an election, but not the right to limit the right to vote, once registration has been completed.
