This proposal provides several limitations with respect to the exercise of the power of eminent domain and the taking of private property for public purposes. The proposal provides that any taking of private property for redevelopment purposes must be approved by vote of the appropriate elected city or county governing authority. The pro posal provides that any taking of pri vate property for redevelopment pur poses must be for a public use as defined by general state law. The proposal provides that the exercise of eminent domain by cities and counties can be restricted by gen eral state law and that any exercise of eminent domain by a nonelected housing or development authority must be approved by vote of the ap propriate elected city or county gov erning authority. This proposal authorizes THURSDAY, OCTOBER 19, 2006 the General Assembly to provide for special motor vehicle license plates to be made available for optional purchase. The General Assembly is authorized to dedicate some or all revenue from the sale of the special plates for programs relating to the subject of the special plate. The dedicated revenue may go to an agency, a fund, or a nonprofit corpo ration and may be for the ultimate use of a nonprofit corporation if found to benefit both the state and the nonprofit corporation. Such dedi cated revenue shall not be paid into or lapse to the general fund of the state treasury. Any law of this type will have to be passed by a two thirds' majority in both the Senate and House of Representatives. SUMMARY OF PROPOSED STATE WIDE REFERENDUM QUESTIONS Pursuant to Code Section 21-2-4 of the 0.C.G.A., the Secre tary of State is authorized to include with the summary of proposed con stitutional amendments a summary of any state-wide referendum ques tions to be voted on at the same general election: - A- To expand the ad valorem tax exemption for farm equipment. House Bill No. 203 Act No. 26 Ga. L. 2005, p. 140 "() YES () NO Shall the Act be approved which expands the ad valorem tax exemption for agricultural products and equipment to include certain ad ditional farm equipment held under a lease purchase agreement?" This Act expands eligibility for the existing ad valorem tax ex emption for farm tractors, combines, and other farm equipment so that the exemption will apply to equip ment which is held under a lease purchase agreement. If approved by a majority of the voters, the Act becomes ef fective on January 1, 2007, and ap plies to all tax years beginning on or after that date. -B- To expand the ad valorem exemption for veterans organiza tions to include organizations which refurbish and operate historic mili tary aircraft for educational pur poses. L. 2006, p. 235 ”() YES () NO Shall the Act be approved which expands the ad valorem tax exemption for veterans organiza tions to include certain additional nonprofit veterans organizations which refurbish and operate historic military aircraft for educational pur poses?" This Act expands the exist ing ad valorem tax exemption for certain veterans organizations to in clude property which is owned by and used exclusively by any veter ans organization which is qualified as a nonprofit organization under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, and which has been or ganized for the purpose of refurbish ing and operating historic military aircraft acquired from the federal government and other sources, making such aircraft airworthy, and putting such aircraft on display to the public for educational purposes. If approved by a majority of the voters, the Act becomes ef fective on January 1, 2007, and ap plies to all tax years beginning on or after that date. -C- To expand the ad valorem tax exemption for property of chari table institutions. L. 2006, p. 76 “() YES () NO Shall the Act be approved which grants an exception from ad valorem taxation on property owned by a charitable institution which gen erates income when that income is used exclusively for the operation of such charitable institution?" This section of this Act ex- 3B
